The Secretariat for Property Protection of the Municipality of Budva has prevented a Russian citizen, the owner of the Budva-based company “Iventa”, from selling a comfortable 78 square meter apartment in the Budva settlement of Seoce iznad Jaza, which is registered with the local administration. The Secretariat for Property Protection, as Vijesti was told, refused to give its consent to the sale of the apartment, which rendered the sale, which had already been concluded before a Budva notary, invalid.
The contract was concluded with a Ukrainian citizen who, as stated, provided money in advance.
A criminal complaint by another Russian citizen, a co-owner of the aforementioned company, has been filed with the Higher State Prosecutor's Office, accusing the partner of unknowingly beginning to alienate property.
And the problem of eight municipal apartments in this beautiful settlement above Jaz beach does not end there, because the municipal Secretariat for Property Protection received a warning that the apartments are being rented out, and that the Russian citizen is using the money earned in this way to pay off his utility bills, for which the Municipality seized these properties a decade ago.
The Secretariat for Property Protection, as Vijesti was told, is waiting for its colleagues from the Secretariat for Communal and Housing Affairs to evict "third parties" who are illegally residing in the apartments.
"The Secretariat for Property Protection submitted a request to this body dated August 15, 2023 for eviction Yuri Vozniuka from special parts of building no. 1, marked as PD1, PD4, PD5 and PD8 on land plot 368/1 KO Prijevor and for the eviction of unknown persons from a special part marked PD6 of the same building, which are the property of the Municipality of Budva in the amount of 1/1 (LN no. 342). Acting on the above request, by reviewing the case files, it was determined that the named person resides only in one apartment marked PD1 based on the lease agreement (expired in May 2024), and it was not possible to determine who resides in the other apartments", the Secretariat for Communal and Housing Affairs officially responded to "Vijesti".
As they point out, for the aforementioned reason, the Secretariat for Communal and Housing Affairs addressed the Police Directorate, Budva Security Department, with a request to establish the identities of the persons residing in the apartments in question.
"The letter from the Budva Police Department dated October 29, 2024 stated that only one apartment, marked PD1, was occupied by Russian citizen Jurij Vozniuk, and that the other apartments contained mostly foreign nationals."
"Since it is not possible to determine from the aforementioned letter whether the persons found are currently residing in the apartments or using them for a longer period on some other basis, and their place of residence is unknown, the process of appointing temporary representatives is underway," the letter states.
The Municipality of Budva previously announced to "Vijesti" that it would initiate criminal proceedings and evict eight municipal apartments suspected of being used and rented by a foreign citizen for years.
The editorial office of "Vijesti" was again sent a letter stating that these apartments have been used by a foreign citizen for three years, and that one apartment has been sold, and that the sale of the other apartment is being prepared. The letter was accompanied by a purchase and sale contract, which was concluded before a notary, as well as a warning that the Russian citizen, co-owner of the company, submitted to all state addresses, from the prosecutor's office to the cadastre, in which he warns them to prevent the illegal sale of his business partner's property.
We remind you that, based on unpaid obligations from the contract on the fee for communal equipping of construction land (utilities from 11 November 2014 and annex from 5 May 2016), the Municipality of Budva was registered as the owner of parts of the building registered in the cadastral records on plot 368 KO Prijevor I". Namely, the Municipality became the owner of eight apartments of 76, 61,77, 77, 59, 78, 78, 59 and XNUMX square meters. The letter mentions that at the time of taking over the apartments, eight years ago, they were in a "gray phase". At that time, the foreign company that owed for utilities and its executive director JK hired a domestic company that completed the furnishing of the apartments, but was never paid for the work. The company sued the foreign company and filed several criminal charges, as stated, and the proceedings are ongoing. A foreign citizen has been renting out six municipal apartments, out of eight, for the past three years, and is using the rental money to partially pay off the debt for utilities to the Municipality.
The municipality is (still) inventorying its property
The Municipality should have known what it owned at the beginning of this year, by which time the municipal commission was supposed to complete the property inventory. The commission was formed in early July last year by the then-vice president of the Municipality, Jasna Dokić, who was dismissed in early December by the then-president of the Municipality, Milo Božović, who issued a decision in the Spusk cell of the Remand Prison.
Political turbulence, two election processes over the past year, prevented the commission from completing its work.
The new city administration was formed in early February, with the election of Nikola Jovanović as Mayor, who promised to conduct an inventory of all property owned by the Municipality of Budva.
The local administration was involved in the property inventory five years ago, when the then First Vice President of the Municipality, Vladimir Bulatović, presented the first preliminary property card of the Municipality.
As Bulatović told "Vijesti" at the time, the Municipality of Budva is the owner or co-owner of 49,4 million square meters of land and 64.902 square meters of commercial and residential space in the territory from Jaz to Buljarica. The minimum estimated value of this property, as announced at the time, was around 270 million euros, if a square meter of land is calculated at six euros, and residential and commercial space at 300 euros.
"Realistically, the value of the property is several times higher and exceeds one billion euros," Bulatović told "Vijesti" at the time.
There was a proposal to engage a law office specializing in property-legal relations, whose task was to solve all the problems that were identified. The proposal was also to form a municipal directorate for property, which would help the local administration to solve all accumulated problems related to property and make good records.
