The Administrative Court of Montenegro has annulled the decision to dismiss Gordana Radojević from the position of Director of the Statistical Office, which was adopted by the Government of Montenegro in 2021 and 2023.
In a statement submitted to the media, Radojević stated that the reasoning of the verdict stated that the reasons for the dismissal were not based on material evidence, nor were they established and explained in accordance with the law and practice of the European Court of Human Rights.
She said that the Administrative Court found the decision to be illegal, annulled it and returned it for reconsideration, with the obligation for the Government to adopt a new, legal one.
"This is the second ruling of the Administrative Court determining the illegality of the dismissal of Gordana Radojević from the position of director of the Statistical Office," said Radojević.
Gordana Radojević's attorney, lawyer Miloš Vukčević, provided a review of the ruling of the Administrative Court of Montenegro of June 27, 2025, which for the second time annulled the illegal decision of the Government to dismiss the Director of the Statistical Office.
"With this verdict, the court clearly and precisely determined that the Government did not comply with the most basic legal standards, and did not fulfill the obligations prescribed by our laws, and in particular, court decisions that had previously pointed out irregularities in this case were not respected. In the reasoning of the verdict, the court highlighted several key shortcomings that make the Government's decision unlawful," the lawyer stated.
Vukčević explained that the decision did not contain valid reasons and factual indicators on which to base it.
"The reasoning was reduced to particularly vague and contradictory claims without a single real, concrete evidence. The court emphasized that such conduct is not in accordance with the legal obligation for the administrative body to obtain, use and present evidence, and to make a clear, impartial and objective decision," he stated.
The court found that Radojević did not have a real opportunity to comment on the allegations against which she was defending herself during the decision-making process.
Vukčević also mentioned the worrying fact that this Government decision was essentially almost identical to the previous decision that was previously annulled by this court's verdict, and the court also previously clearly indicated that the same procedural and material shortcomings existed in the proceedings.
"We expect that the Government will finally adopt a legally valid solution within 30 days based on this verdict and respect the legal standards prescribed by the Administrative Court, which will correct the injustice inflicted on my client," Vukčević told "Vijesti".
