Despite the fact that the Municipality of Kolašin has notified the competent inspectorates several times, sent an emergency letter two days ago, and in the meantime filed a criminal complaint, construction on a private plot in the Dulovine Forest Park continues.
According to unofficial information from "Vijesti", the plot on which the construction is taking place has not yet been inspected. As the Municipality said, the response to the letters from the state level has also not arrived. On the ground, it is obvious that the owner of the plot is continuing the works, which began in June. The Municipality of Kolašin states that they have exhausted all possibilities within their jurisdiction to prevent the construction.
The owner of the plot was verbally warned several times by local authorities about the consequences and obligations arising from the law, but, regardless, he continued the work without a permit. Therefore, an urgent response and decisive action by the competent state authorities are now expected at the local level, in order to prevent further destruction of the area and repair the damage caused.
The Municipal Inspection also filed a criminal complaint with the Basic State Prosecutor's Office (ODT) in Kolašin against Ž. D. and ND for the criminal offense of constructing a building without registration and documentation, pursuant to Article 326a of the Criminal Code of Montenegro. The case relates to the construction of a building on cadastral plot no. 946/10 KO Kolašin, in the Dulovine settlement.
"On this occasion, the Prosecutor's Office sent a letter to the Directorate for Inspection Supervision of the Ministry of Spatial Planning, Urbanism and State Property, requesting that the inspection be carried out as soon as possible and that a statement be made as to whether the building in question constitutes a building within the meaning of the Law on Construction of Buildings," the head of the Kolašin Public Prosecutor's Office told "Vijesti". Maja Šćepanović.
The owners of the plot, who are building in the Dulovine Forest Park, have not responded to calls and messages from the editorial team this time either.
As the Secretariat for Environmental Protection said back in July, the criminal charges against Ž. D. and ND were preceded by warnings that construction could not continue on the plot located within the future protected area of the Dulovine Forest Park. Verbal warnings, that is, the local authorities' position that they would not allow the devastation of the future protected area and illegal construction, were communicated to the plot owner in recent days.
The devastation within the planned protected area began in the fall of 2023, when more than 10 pine and poplar trees were illegally cut down on that private plot. In November of the same year, the Forestry Administration established the illegal logging and initiated proceedings, the results of which have not yet been made public. According to data at the time, the gross mass of the felled black pine trees was about 11,2 cubic meters, and of poplars close to three cubic meters.
At the logging site, at the end of June this year, the terrain was leveled and minor construction work was carried out, namely, the manhole was walled in. The structure of the facility was installed in July, to which the competent municipal services immediately reacted.
The plot is located in the immediate vicinity of the Botanical Garden. The protection study for the Dulovine Forest Park should soon be put to a public hearing, the Secretariat for Environmental Protection said earlier. The protection of this area was proposed three years ago. Permanent protection would allow Dulovine to be preserved from future devastation and construction, which the current planning documents do not allow.
The planned protection includes more than 10 cadastral plots, with a total area of about 50.000 square meters. The protection initiative states that Dulovine is “practically the only green area left in the ownership of the Municipality of Kolašin, and is located close to the city center.” In the late XNUMXs, a stand of black and white pine was planted in the area.
