Radunović sees no reason not to issue a permit for the construction of the collector, but gives Zeta the right to challenge it?

"This is just an attempt to delay the process and leaves the possibility that Zeta will dispute the issued building permit, that the construction of the collector will not begin, and that Podgorica will pay penalties," say sources for "Vijesti".

Minister of Spatial Planning, Urbanism and State Property Slaven Radunović has issued a decision according to which the Municipality of Zeta is recognized as a party in the proceedings of the Capital City and the Podgorica-based company "Vodovod i kanalizacija" for the issuance of a building permit for the construction of a wastewater treatment system (collector) in Botun, "Vijesti" has learned.

According to unofficial information, this solution allows the Municipality of Zeta to dispute the construction permit for the collector if it were issued by Radunović's department.

"Vijesti" sources claim that Zeta cannot be a party to the proceedings, because it has not yet demarcated its border with Podgorica, and that the plots are owned by the Capital City.

"This is just an attempt to delay the process and leaves the possibility that Zeta will dispute the issued building permit, that the construction of the collector will not begin, and that Podgorica will pay penalties," say sources for "Vijesti".

The capital, as previously announced several times, would have to pay around 100 million euros if construction of the facility does not begin by the end of the year.

The appeal of the Municipality of Zeta against the issued building permit could, according to editorial sources, sufficiently extend the deadlines for the start of construction, and thus activate clauses on the payment of penalties.

"Vijesti" sources also state that such a solution "gives almost the same rights to Zeta and Podgorica."

Radunović, the RTCG portal reported today, said that the documentation for the collector in Botun has been collected. As he pointed out, after minor omissions that were returned for correction, there will be no single legal reason not to issue a construction permit.

"The problem that the citizens of Botun have is with pollution from the then aluminum plant (red mud pool). The living conditions there are terrible. The water is poisoned, and this was another addition to these incidents that occurred with overflow from Podgorica from the collector of this old one, which was designed for fifty thousand people, so all of this further aggravated the situation," said Radunović.

The decision was justified by the provisions of the Law on Administrative Procedure, which stipulates that a party can be a natural or legal person "at whose request an administrative procedure was initiated, on whose rights, obligations or legal interests the administrative procedure is conducted ex officio, or who, in order to protect their rights and legal interests, has the right to participate in the procedure".

According to information from "Vijesti", the Municipality of Zeta expressed its legal interest by appealing the decision by which the Environmental Protection Agency gave its consent to the environmental impact assessment study for the collector construction project.

The director of Podgorica's "Vodovod" Aleksandar Nišavić recently announced to "Dan" that the owner of the plot, on which the construction of the collector is planned, is listed in the real estate register as the property of the Capital City, in the amount of 1/1, without encumbrances or restrictions.

At the proposal of Radunović's department, the Government of Milojko Spajić this summer adopted the Spatial and Urban Plan of Montenegro, which, in addition to the construction of the plant in Botun, also envisages the construction of another, similar, plant in the municipality of Zeta.
