The Budva-based company "Aquaterra solutions", which is behind the failed aqua park project on the Topliš hill above Budva, has been blocked for 4.294.501,84 euros.
This is stated in the latest report of the Central Bank, which "Vijesti" had access to.
The municipality is trying to collect debts worth millions by selling equipment. As "Vijesti" was told, the Secretariat for Property Protection has sent an urgent request to the public bailiff. Darko Rajković to schedule the sale of movable property and equipment of the defunct Aqua Park.
"The day before yesterday we sent a conclusion on the advance payment for the public sale, it was paid yesterday, so we expect a quick scheduling of the hearing," the secretariat told "Vijesti".
Conceived as the biggest tourist attraction, which it was in the beginning, the project of the large water city has been practically sunk by millions of liabilities, which many creditors are demanding from the failed company. The aqua park has been closed for two summers, and tourists have not been able to enjoy the water attractions.
According to the Central Register of Business Entities, the company was founded in 2014 by "Brockhampton Investments Limited", and from 2021, in addition to this company, half of the capital went to LLC "Avanti". After that, "Henderson Holdings Limited" and "Castelmaine Holdings Limited" emerged as founders with 48,5 percent of the capital each, while three percent was held by Sahret Hajdarpašić.
Five years ago, changes occurred again, and the companies "N4 foundation" and "Trakom fondation" were registered as founders with 50 percent of the capital each. Since 2021, half of the capital has been held by the company "Advent east estates SRO", while "N4 foundation" and "Trakom foundation" have dropped to a quarter share each.
The listed property, which Rajković carried out in February of this year, was estimated at only 648 thousand euros, and the right to collect first belongs to the Belgrade bank, which placed a pledge on the half a million euro loan it gave to the failing company.
As "Vijesti" previously reported, when the public bailiff was making an inventory of belongings and equipment, in addition to the Municipality representative, there was also a representative of API Bank from Belgrade, who stated that the bank had a lien on movable property in the amount of more than half a million euros.
The company "Aquaterra solutions" has not paid a single cent to the Municipality for the lease of the land complex in Topliš on which the aqua park was built in the past five years, nor did it pay a cent last season when the largest water attraction in this part of the Adriatic was closed to guests, and the equipment was left to the ravages of time and is in extremely poor condition.
The Secretariat for Property Protection filed a lawsuit with the Commercial Court in early February this year to terminate the contract with the company "Aquaterra Solutions", demanding that the local government take over all the buildings built on the plot on Topliš Hill. The municipality refers to a long-term lease agreement concluded with the tenant a decade ago, which stipulates that, if the tenant fails to regularly settle its obligations, the municipality has the right to terminate the contract.
The long-standing problem with the tenant, the company "Aquaterra solution", culminated in the Municipality's decision to collect the rent for 2019 in the amount of 215 thousand euros, which was confirmed by a final judgment of the Court of Appeal, by selling the property, that is, the inventory in the water city. The remainder, which almost reached one million euros, in the name of rent for the past four years, the Municipality will have to collect from the tenant through the courts.
The municipality concluded a long-term lease agreement with Aquaterra Solutions on December 24, 2014 for the construction of an aqua park. The annual lease price for four hectares of municipal land was 255.000 euros.
Legal representatives of the company "Aquaterra solutions" previously told "Vijesti" that the company had contacted the Municipality several times, but they did not receive a permit to operate, which is why the tourist attraction was closed all summer.
An additional problem was that the company had not paid bills for water consumed to the city's water utility for two full years, which exceeded 125 thousand euros, which is why the complex was disconnected from the network.
