Trade Union: Government members should not adopt the Rulebook on the systematization of jobs at the Ministry of Sports and Youth

The Administration and Judiciary Union of Montenegro announced today that it has officially addressed all members of the Government of Montenegro, with a recommendation that, presumably on Thursday, at the regular session of the Government, they do not give their consent to the adoption of the delegated Rulebook on the systematization of jobs of the Ministry of Sports and Youth.

"The systematization proposal, in its procedure of adoption by the ministry, bypassed the binding legal steps, and therefore its content is completely illegal and null and void. Those responsible from the Ministry of Sports and Youth, in accordance with Article 193 of the Labor Law and Article 26 of the Sectoral Collective Agreement, did not request or receive a binding opinion from the Union, then the Union representative was not a member of the working group for drafting the proposal, and finally they did not inform the employees about the aforementioned proposal, which they should have displayed on the notice board," the statement of the Union of Administration and Judiciary states.

The union added that "if the Regulation is adopted by the Government, it will initiate a constitutional lawsuit, as well as a large number of lawsuits against future solutions, which will all be annulled and abolished tomorrow through proven court practice, which will cause enormous costs that will all fall on the state."

"Taking the above into account, hypothetically everyone who votes for the proposed systematization will have a great responsibility. We appeal to all members of the Government to reject the proposed systematization, because it is closely tailored to party interests, where a significant number of professional, expert and managerial staff are to be demoted, and a certain number are to be sent to the Human Resources Administration for assignment, after which their employment status will cease after six months by force of law. All these very autocratic procedures are aimed at creating an environment for employment and the appointment of new staff from a newly formed party, while all those who did not want to sign their membership in the party or sign as a form of support for its formation have been put on a list to be shot," the statement reads.

The Union of Administration and Judiciary said that "the great pressure on employees of the Ministry of Sports and Youth, as well as the actions and actions taken for a long time, are known to the Union of Administration and Judiciary, because they are very similar and are a pattern of behavior of Jelena Perović during her time at ASK."

"As in her case, we will present more than enough reasons to the relevant state positions and investigative bodies to prosecute those responsible if they do not react in time and protect the interests of an important state body in the form of the Ministry of Sports and Youth," said the Union of Administration and Judiciary.
