The Venice Commission (VC) has adopted a Proposal for an Opinion on the Draft Law on the Constitutional Court of Montenegro, the Ministry of Justice of Montenegro announced today.
The statement added that the adopted opinion stated that Montenegro had accepted and fully implemented three out of four recommendations of the High Council.
"With regard to the fourth recommendation, it was assessed that the envisaged solution is in line with European practice and the recommendations of the Venice Commission, and that additional clarification of the proposed solution is necessary. In this regard, the Ministry of Justice will proceed with additional normative harmonization in accordance with the aforementioned opinion in the coming period. Namely, the fourth recommendation relates to the issue of extending the mandate of judges of the Constitutional Court after the termination of their office, until the election of new judges," the Ministry of Justice said in a statement.
The government department headed by Bojan Božović said that the Government of Montenegro will be informed of the VK's report as soon as possible, after which, as they stated, the Working Group will further harmonize the norm relating to this issue.
"Upon completion of this process, the Draft Law will be submitted for public debate. The session of the Venice Commission was attended by Deputy Prime Minister Momo Koprivica, on behalf of Montenegro," the Ministry of Justice said.
The statement states that the adoption of the Venice Commission's opinion confirms that the Ministry of Justice has fulfilled its obligations and kept its promise, and that previously expressed criticisms and doubts regarding this process were unfounded.
"Our credible, inclusive and professional approach is best confirmed by the affirmative assessments and comments of the Venice Commission. The rule of law and the protection of human rights remain permanent commitments and a clear path for Montenegro," the Ministry of Justice said.
