The decision of the Supreme Court of Montenegro to accept the request for review of the court decision in the dispute regarding the award of the 2025 July Thirteenth Award and to revoke the decision of the Administrative Court and return the case for retrial and decision-making is expected and follows the previously announced position of the Lawyers' Association of Montenegro, said the president of that association, Branislav Radulović.
"A state governed by the rule of law must be based on the principles of the rule of law and legality, and in this case it has been shown that citizens like Prof. Hajduković, informal civic associations and professional organizations like the Lawyers' Association are unfortunately making more efforts to ensure the actual functioning of the legal system in Montenegro than the state institutions themselves, whose primary task and job is to ensure this," Radulović said in a press release.
He pointed out that the persistent drawing of attention to the violation of Article 17 of the Law on State Awards, according to which only one Thirteenth of July Award can be awarded in one area, was unfortunately ignored by those who were precisely required, by their official duty, to supervise and ensure legality in this matter.
"With the Supreme Court's decision and the repeal of the Administrative Court's decision, and the return of the case for a new trial, we hope that the entire matter will return to the field of unquestionable application of the law and a lesson will be learned for all who persistently follow 'impulse' instead of the law," concluded Radulović.
