Several residents of Zaton claim that a series of omissions were made during the reconstruction of the Bijelo Polje - Berane main road, which is why, if the authorities do not react, they will seek legal assistance.
The investor is the Transport Authority and the project is part of a wider initiative to improve transport infrastructure, the main works have already been completed and the road has been modernized.
Project coordinator Vladan Kekovic In its response to "Vijesti", the company stated that the contractor carried out the work in accordance with the project documentation, which did not foresee additional stormwater drainage, but that the problems that were reported would be resolved during the year.
A local woman Mileva Dangubic explained that during the works, the asphalt road was raised and built at the same level as the curb and the yards of the houses, with the slope of the roadway directed towards her plot, and the existing condition deteriorated after heavy rains.
"Because of this, all the stormwater from the road flows directly into my yard and into the residential building, causing flooding and endangering property. The problem has existed for a long time, and so far, in order to protect my house, I have been forced to independently take temporary measures to prevent water from entering. Given my age and health, I am no longer able to do so," said Dangubić.
Four of her neighbors have similar problems.
Dangubić explained that she had repeatedly addressed the contractor's representatives and the authorities, both verbally and in writing, about the problem, but that no concrete solution had been reached.
“I believe it is technically feasible and necessary to build channels or drains along the road, in order to direct stormwater into the existing drainage channel located about 150 meters from my house. The answer I received, that the road was built 'in accordance with the project' and that the contractor 'did not notice the problem', does not absolve the competent authorities of liability for the damage and endangerment of private property, which apparently occurred as a result of the work carried out.
"I invoke the right to peaceful enjoyment of property and the obligation of the competent authorities to ensure that infrastructure facilities do not cause harm to citizens. For this reason, I request that the competent authority urgently send an expert commission to the site, inspect the situation and order the contractor to create appropriate drainage (canal, drain or other technical solution) in order to permanently prevent further flooding of my yard and house. If the problem is not resolved within a reasonable time, I will be forced to seek protection of my rights through the competent institutions and the court, including other measures permitted by law," said Dangubić.
Keković said that "during the previous rainy period, when a higher amount of precipitation was recorded, the contractor did not notice any drainage problems at that location."
"In any case, the warranty period for the removal of any defects will last for the next year. If additional problems arise during that period, an order will be issued to the contractor to take appropriate measures to ensure adequate drains," said Keković.
