Constitutional Court President Snežana Armenko has adopted a Plan and Program for resolving cases for this year, according to which, as announced, the ten oldest cases will be resolved by April.
The Constitutional Court said that the Plan and Program for Resolving Cases for this year introduces precise deadlines, measurable goals, and bearers of the set obligations for the first time.
"This document defines when specific cases will be resolved, with the obligation to publicly explain any possible deviation from the plan," the statement said.
Armenko said that in the past two years, the Constitutional Court has worked to create institutional and organizational conditions for the adoption of such a plan, aware of the long-standing problems with backlogs and the need to build public trust exclusively through concrete results.
"The Constitutional Court will issue decisions in the ten oldest cases by April. This will begin the systematic resolution of old cases in the area of normative control of regulations, that is, the assessment of the constitutionality of laws and bylaws," said Armenko.
She stated that citizens already have access to the list of unresolved cases, and with this Plan, for the first time, they will know in advance the order in which they will be resolved.
"Any deviation from the Plan will have to be publicly explained. In addition, the Court will also act in current cases, in order to effectively protect the legal order and human rights and freedoms," said Armenko.
The statement states that the plan for this year, which the judges were informed about at the Court session, envisages that the Court will complete cases assessing the constitutionality of laws and bylaws from 2018 by April, while cases from 2019 will be completed by the end of June.
"At the same time, the Constitutional Court will issue decisions on constitutional appeals from 2024 by July, which will be a positive precedent compared to the time when the Court had constitutional appeals that were four or five years old," the statement said.
The Constitutional Court will, as stated, complete the cases from the 2020 regulations by October, and half of the cases from 2021 by the end of the year.
"In addition, in the second half of the year, the Court will resolve constitutional appeals from last year, as well as urgent appeals from the current year," the Constitutional Court stated.
They said that, along with resolving old cases, the Plan also established a minimum number of cases from the recent period that must be completed, which will allow the Constitutional Court to complete more than 1,7 thousand cases from all jurisdictions during the year, not counting priority cases.
The Constitutional Court said that it will regularly inform the public about the implementation of the Plan, with clearly stated indicators of success.
As they stated, additional organizational measures have been envisaged within the Court to ensure its consistent implementation.
