The Ministry of Justice abandoned the criminal offense of mockery, so the Proposal for Amendments to the Criminal Code no longer contains the threatened prison sentence for commenting on the work of courts and prosecutor's offices.
This was announced by the director of the Directorate for Justice in that department, Marijana Laković-Drašković, after the Government session, explaining that the Government made this decision "in the process of interdepartmental and international harmonization of this bill".
"However, the Government has not given up on protecting the authority of the holders of judicial functions, so in the coming period we will try to find a model for ensuring a balance between freedom of expression, which is not an absolute right, and the independence of the judiciary," said Laković-Drašković.
Amendments to the CC foresee a fine or a prison sentence of up to four years for plagiarism and all those who "publish someone else's author's work under their own name in whole or in part, and on the basis of which they are elected to a scientific or teaching-scientific profession".
"This proposal came during the public debate, and from the relevant non-governmental organization," said Laković-Drašković.
During the public debate, the Center for Civic Education (CGO) continuously warned that it is necessary to make plagiarism a criminal offense.
Laković-Drašković also states that the penalties for domestic violence have also been tightened: "For the basic form of this criminal offense, the penalty has been increased from one to two years, while for violating a protection measure determined by the court or another state body, the penalty has been increased from six months for a year".
According to her, an important change is a long-term prison sentence instead of a 40-year prison sentence. She pointed out that the proposed change is a practical necessity, especially in cases where the most serious crimes have been committed, and when there are extenuating circumstances for co-perpetrators.
"New criminal offenses have been introduced - persecution, female genital mutilation and forced sterilization. For the first time, a definition of prostitution was given, and punishment was introduced if this act was committed by several persons and in an organized manner.
"Uveli defines child pornography, so child pornography is considered any material that visually shows a child engaged in real or simulated sexual behavior and any depiction of a child's sexual organs for primarily sexual purposes," explained Laković-Drašković.
