The introduction of mediation has created formal prerequisites for providing more efficient legal protection to natural and legal persons, said Maja Golović Vojinović, executive director of the Center for Alternative Dispute Resolution.
As announced by the Center, in order to affirm and promote mediation as an efficient way of resolving disputes, the President of the Basic Court in Podgorica, Željka Jovović, and the Executive Golović Vojinović held a working meeting.
"The topic of the meeting was the role of courts and judges in referring parties to mediation, as well as ways in which judges can encourage wider use of mediation in everyday dispute resolution practice. The procedure for confirming settlements by regular courts was also discussed," the statement said.
Golović Vojinović, as stated, expressed her gratitude to the President of the Basic Court in Podgorica for her efforts to promote mediation as an efficient way of resolving disputes.
"Namely, experience has confirmed that referring parties to mediation during initiated civil proceedings yields excellent results, both in terms of the success of mediations initiated in this way, and in terms of accelerated acceptance of mediation as the most suitable out-of-court method of resolving disputes," said Vojinović Golović.
As stated in the statement, Jovović highlighted the excellent cooperation between the Basic Court in Podgorica and the Center for Alternative Dispute Resolution.
"In order to achieve wider application of mediation, the role of the court and judges is very important, who should, by understanding the institute of mediation and actively participating in its final phase, ensure that the interests of the parties are satisfied to the greatest extent possible," said Jovović.
As stated by the Center for Alternative Dispute Resolution, Jovović pointed out the importance of joint cooperation through organizing seminars and trainings, as well as project activities aimed at strengthening the institute of mediation in resolving disputes and the role of the regular court in the procedures for confirming concluded settlements.
"She introduced the attendees to the Pilot Project for Improving the Efficiency of Proceedings, which is the responsibility of the Basic Court in Podgorica, and in that context, the need to implement the Plan of Procedural Measures and the importance of the Center as a partner on that path. The meeting was attended by Milena Brajović, Deputy President of the Basic Court, Mirza Ademović, President of the Civil Department, Borislav Ivanović, Judge of the Non-Contentious Department, and Ivan Knežević, Head of the Alternative Dispute Resolution Department of the Alternative Dispute Resolution Center," the statement concludes.
