Despite the findings of the building inspection and the criminal charges filed, residential buildings are being constructed in the center of Petrovac without a permit.
Petrovčanka claims this. Marijana Raskovic, who lives in a nearby building and has filed several complaints to have the works stopped, because the property of citizens is at risk.
"On the cadastral plot KO Petrovac 579 and neighboring plots, in the immediate vicinity of Street XVII, number 11, illegal construction of two buildings is underway in an area that is defined as green space by the valid planning documentation. Two buildings are being built without a building permit, without registration of works and without technical documentation. The construction site is not marked or secured in accordance with the law, and the work is being carried out by unskilled persons without supervision. One building was built directly on the supporting wall of an existing residential building, which seriously threatens the stability of the building and the safety of the tenants," Rašković states.
As she said, the second building, measuring more than 150 square meters, was built in the immediate vicinity of the residential building, which further violated the prescribed distance between buildings.
"This not only threatens security, but also represents a direct violation of the privacy of the residents, given that the building encroaches on their immediate living space. The works have been carried out at an accelerated pace since the beginning of March, with the obvious aim of completing the illegal construction and attempting subsequent legalization, although there are no legal requirements for this," Rašković said.
He claims that the building inspection went to the site and determined that it was illegal construction, and that criminal charges were filed against the person responsible.
"Also, an additional complaint has been filed against persons engaged on the construction site for threatening and harassing residents. Despite this, the works continue unhindered and without any reaction from the authorities," she points out.
As he emphasizes, the construction is being carried out in violation of the Law on Spatial Planning and Construction of Facilities.
"The construction is taking place on an area designated as a green zone, where construction is not permitted. There is no building permit or technical documentation, the works are being carried out without reporting to the competent authorities, the construction site is unmarked and unsecured, and the works are being carried out without professional supervision. There is a basis for suspicion that the criminal act of illegal construction has been committed in accordance with the applicable legislation," Rašković pointed out.
According to her, there is a real risk of the retaining wall collapsing due to inadequate load.
“Construction is taking place on geotechnically unstable and potentially landslide-prone terrain, without any stabilization measures in place. There is a high risk of landslides, subsidence and loss of stability of buildings. The immediate proximity of the existing building directly threatens the safety of residents. Conditions are further worsened by rainfall and increased soil moisture. The construction site poses an immediate danger to citizens.
"At a time when the state is publicly promoting the fight against illegal construction, the case in Petrovac shows a serious gap between official policy and the situation on the ground. The continuation of works, despite the identified irregularities, initiated procedures and filed reports, indicates that laws are not being applied and that institutions are not reacting even in situations where violations are clearly documented. If the competent authorities do not react urgently and without delay, stop the works, seal the construction site and issue a decision to return the site to its original state, the question arises of their real ability to implement their own decisions and ensure the protection of citizens," concluded Rašković.
