The Navigation Safety Inspectorate of the Ministry of Maritime Affairs has made an official note and within three days will issue an order to the company "Gugi Commerce" from Budva to immediately remove the large floating pontoon that it placed in the sea in front of its new hotel "Ollie's" in the Opatovo settlement near Tivat last weekend, without the necessary consent.
This was unofficially confirmed to "Vijesti" by the Ministry of Maritime Affairs, with the explanation that inspectors acted on a citizen's report and determined that "Gugi Commerce" does not have a permit, or rather consent, from the Kotor Port Authority to install a floating sunbathing plateau of 250 square meters in the sea in front of cadastral plots 19/1, 19/2 and 19/3 of the Donja Lastva Municipality.
According to the Law on Maritime Navigation Safety, for construction interventions on the coastline, as well as for the installation of temporary structures such as pontoons, fish farming cages, buoys and other obstacles in the sea, or for interventions that change the configuration of the coast and the sea and may make it difficult for vessels to safely pass, dock or anchor, prior consent must be obtained from the locally competent port authority, or the Directorate for Navigation Safety of the Ministry of Maritime Affairs.
"Gugi Commerce", according to the inspector's findings, did not have such consent. The company, as determined, does not even have a valid certificate from the Technical Inspectorate of the Ministry of Maritime Affairs on the inspection and proper functioning of the floating facility - the beach sunbathing plateau that was placed on Opatovo.
Therefore, the Navigation Safety Inspectorate carried out a new inspection yesterday, during which the inspector Željko Lompar was allegedly exposed to provocations by representatives of the company "Gugi Commerce", for which Lompar reported them to the police.
A Budva company, owned by a businessman Branislav Gugi Savić, convicted several years ago as a member of the Budva organized crime group led by Svetozar Marović, however, continued its activities in the Opatovo waters yesterday.
Additional plastic elements intended for new floating installations - platforms for docking and stationing scooters and other smaller vessels - were brought in by trucks and unloaded on the shore.
At the end of May, the Navigation Safety Inspectorate fined "Gugi Commerce" and ordered the company to remove 24 large concrete blocks - anchors - from the seabed in front of the hotel in Opatovo, which it had previously lowered into the sea to secure a future floating sunbathing pontoon, or a pontoon for docking vessels.
The inspection then concluded that the investor, at the time he was carrying out works in the sea, did not have a signed contract on the lease of that part of the coast and the water area with the Public Company for Coastal Zone Management, but only a draft contract.
Even for the installation of concrete anchor blocks, the legally required consent of the Ministry of Maritime Affairs - Directorate for Navigation Safety, or the Kotor Port Authority, was not obtained.
In the meantime, the contract between the Coastal District and "Gugi Commerco", as the most favorable bidder for the lease of the location, was signed, and Savić's company became the lessee of the "public family swimming pool" on cadastral plots 19/1, 19/2 and 19/3 of the Donja Lastva municipality.
The contract provides for a total area of 500 square meters, or two floating beach plateaus consisting of eight concrete floating pontoons measuring 12,5 by 2,5 meters.
Of the two plateaus stipulated in the contract, "Gugi Commerce" set up one last weekend, at a location marked as 3E in the current Program of Temporary Facilities in the Coastal Zone for the Municipality of Tivat for the period 2026–2028.
Such content on that location was included in the Program based on a request from "Gugi Commerce", submitted four years ago.
The Program of Temporary Facilities in the Coastal Zone is adopted by the Ministry of Spatial Planning, Urbanism and State Property, without a formal obligation to accept the opinion of the coastal municipalities to whose territory the Program applies.
In the meantime, the Municipality of Tivat has issued "Guga Commerco" with the approval of the chief city architect for the conceptual design of the floating beach in Opatovo, with the assessment that it was designed in accordance with the urban planning and technical conditions that the company previously received from JP Morsko dobro.
It is not clear why the solution of the chief city architect of Tivat Aleksandar Živaljević dated June 11th of this year, although its explanation states that "Gugi Commerce" approached the Chief City Architect's Office with a request for approval of the conceptual design five days later - June 16th.
The floating beach at Opatovo was placed in the sea in front of the recently opened hotel "Ollie's" by the company "Gugi Commerce".
The hotel building was legalized on March 16th in the so-called “shortened procedure” conducted by the Ministry of Spatial Planning, Urbanism and State Property, headed by the Minister Slaven Radunović (New), with the participation of the Municipality of Tivat.
