The Bjelopolje High Court released the policeman DL, the accused for illicit sexual acts committed to the detriment of a minor.

This is what the Higher State Prosecutor's Office in Bijelo Polje told Vijesti, stressing that they appealed against such a decision of the Higher Court.

Yesterday, the court did not respond to Vijesti's questions - which single judge, or which panel made that decision and how they explained it.

The 54-year-old police officer was arrested in mid-January, after the family of his 13-year-old neighbor reported that he tried to assault her.

On April 8, the Bijelo Polje Prosecutor's Office submitted an indictment against him to the High Court there, the spokeswoman for VDT Bijelo Polje told Vijesta. Ljubica Ćuković.

"The Higher State Prosecutor's Office in Bijelo Polje filed an indictment with a proposal for the extension of custody to the High Court in Bijelo Polje on April 8, 4, against the accused DL from Šavnik, for the criminal offense of illicit sexual activity, committed to the detriment of a minor. By the decision of the High Court in Bijelo Polje, the indictment of this prosecution was confirmed on April 2024, 24, and the main hearing was scheduled for June 4, 2024," she explained.

Answering questions about the decision on custody and the date of submission of the motion for extension, she explained:

"In addition to the indictment, the Higher State Prosecutor's Office in Bijelo Polje also proposed the extension of detention according to the accused DL on April 30, 4, the non-trial panel of the High Court in Bijelo Polje canceled the detention of the accused, determined by the decision of that court, which decision was acted upon by the state the prosecutor submitted an appeal to the Appellate Court of Montenegro within the legal deadline, and the prosecution has not yet received a decision on which appeal".

Police officer DL was arrested on January 15 on suspicion that the night before, in a town in the north of Montenegro, he tried to assault a minor neighbor.

According to information from Vijesti, when the girl was passing by his house, he invited her to watch the game with his children, and then tried to assault her.

The news reported at the time that the girl contacted her parents, telling them that she was going to watch the game with the kids from the neighborhood and went to their house, and shortly after that she ran into the house and told them what happened.

“DL was home alone and immediately started groping her and tried to kiss her. She pushed him away and ran home," the interlocutor of Vijesti said at the time.

On the same day, the Police Administration officially confirmed the information to Vijesta about the arrest of their officer, explaining that they handcuffed fifty-four-year-old DL on suspicion of having committed the crime of illicit sexual activity against a 13-year-old girl.

"The police officers acted on the report and undertook activities within their competence in cooperation with the acting senior state prosecutor and deprived DL of his liberty for the above-mentioned criminal offense, which, as is suspected, he committed on January 14 in his apartment," they said at the time from UP.

Today, a protest due to the reduction of the sentence for the rapist

Due to the recent decision of the Appellate Court to reduce the sentence from a maximum of 15 to eight years in prison for BB, who was convicted of multiple rapes of a girl, a protest is scheduled for today in front of the court building in Podgorica.

The non-governmental association Parents called for the protest, scheduled for 12 noon.

"We are looking for stricter, not incentive, punishments for abusers," says their call to the "Protect the Children" protest.

Due to the decision of the Court of Appeal, which was made known to the public by Television News, the Women's Club of the Assembly also reacted, from which they said that they expect a review of the verdict in the case of multiple rape of a girl and that a just punishment will be imposed for that crime.

They said they condemned the decision of the Court of Appeal for a crime which, they said, had caused shock and outrage in the community:

"The decision that was made, reducing the sentence from a maximum of 15 to eight years in prison, is not only unacceptable, but also shameful."

They pointed out that the message being sent to victims and society as a whole, diminishes the seriousness of such heinous crimes and undermines confidence in the justice system.

On the other hand, yesterday the Appellate Court announced that they understand the public's need to express dissatisfaction with their decision, bearing in mind the type of criminal offense and the category of the victim.

"However, the Appellate Court of Montenegro made its decision on the basis of a careful and comprehensive analysis of the case file and on the basis of the judge's free opinion in accordance with the law, for which he gave reasons in the explanation of the verdict. The court imposed a punishment on the perpetrator of the criminal offense within the limits prescribed by law for that criminal offense and in accordance with the criminal policy expressed through the available judicial practice, finding that the punishment imposed in the specific case achieves the purpose of punishment from Article 32 of the Criminal Code of Montenegro within the general purpose imposition of criminal sanctions from Article 4 of the same law".
