Although the deadline for the re-registration of Montenegrin sports clubs in accordance with the new law lasted until November 14 last year, and for sports associations until January 14 this year, there are still many uncertainties, and the Ministry of Sports of Nikola Janović has not answered questions for a month and a half. Two months after the clubs and associations submitted the documentation for re-registration, the Ministry had to issue a decision to confirm the re-registration, request an amendment or correction of the submitted documentation or issue a decision on deletion.
Many sports organizations have not received any decisions or any other acts from the ministry. The problem is that other competent institutions - Monstat, the Central Bank and the Tax Administration - have not been informed about the deletion of sports organizations, which are legal entities with giro accounts and stamps, so their giro accounts and stamps remain active, which can create abuses. .
On February 14, "Vijesti" sent the following 22 questions to Janović's Ministry:
What is the further procedure for sports clubs that did not submit any documentation in the re-registration procedure?
Are the Bureau of Statistics and the Central Bank notified of their deletion from the register so that they are also deleted from their registers?
What happens to their giro accounts, are they closed?
If those clubs have debts or deficits in their accounts, do these obligations now fall on the founders?
What is the further procedure for national sports associations that have not submitted documentation or do not have five active clubs?
Will they receive removal orders from the registry?
Do they have the right to appeal and, if so, does the appeal delay the decision on deletion from the registry?
Are the Bureau of Statistics and the Central Bank notified of their deletion?
Are their giro accounts closed, who initiates the process of closing giro accounts and who takes over their eventual debts?
Can sports clubs whose associations have been deleted can establish new associations and under what conditions?
Is there a deadline for that?
What will happen to clubs and associations that have not submitted complete documentation or that has some deficiencies?
Will those clubs and associations receive solutions on this and recommendations on how to act?
Will they have a deadline to supplement and correct that documentation?
Have local governments announced tenders for co-financing sports clubs?
Will the Ministry monitor whether these competitions are conducted in accordance with the law on sports?
Is there a deadline by which municipalities should publish these tenders?
Has the Sports Council and Anti-Doping Commission been formed?
Who are their members and what will be the responsibilities of these bodies?
Should municipalities form local sports councils and within what time frame?
The Institute for Sports Medicine should be established within two years from the entry into force of the new sports law. As seven months have already passed since the entry into force of the law, have the activities on the formation of this institution begun?
Where can children and adult athletes perform mandatory medical examinations until then, and will the ministry participate in these financial costs?
How is it possible that everyone misunderstood the ministry
The Minister of Sports and Youth, Nikola Janović, said at a press conference on March 12 this year that out of over two thousand clubs, about 800 submitted documents for re-registration, while the rest were automatically deleted. However, they did not pass individual acts on deletion.
- None of the 800 sports organizations submitted proper documentation, although the department I headed previously took all the necessary steps to help sports clubs get out of this process as easily as possible through the preparation of document matrices, statute statements and part of other documentation and precise explanations of the re-registration procedure, which once again confirms the justification of the obligation introduced by law to educate administrative structures in clubs and associations - said Janović at the time.
The question remains how it is possible, if everything was prepared and well explained, that none of the sports clubs submitted complete documentation despite the "efforts of the ministry".
The minister then thanked his colleagues because "during this process, they resembled the Ministry of Legal Aid and had 500 meetings with representatives of clubs and associations". It is obvious that many people still did not understand what the ministry was asking of them.
The minister stated that until then (February 12) they had issued 150 decisions for clubs, although the deadline for responding to all 800 requests for re-registration was January 14 at the latest.
Janović stated that out of 60 national sports associations, 42 submitted documentation for re-registration, of which they confirmed the registration for 12 by February 30. It was not answered which associations were deleted.
