The kindergarten "Dragan Kovačević" in Nikšić has been in the public's focus since January, since the Ministry of Education, Science, Culture and Sports dismissed the then director, Radmila Backović, due to work errors.
The new management of the kindergarten claims to have inherited the institution's debt of over 100, numerous abuses of official position, as well as court cases with employees.
For three and a half years, former teacher Dragana Krsmanović has been on trial with the institution, who claims that she was discriminated against and illegally fired from her job, which she is trying to prove in court.
"Of the 20 or so kindergartens in Nikšić, I worked in 16 as a substitute. And I wasn't good enough to stay there like many others," says Krsmanović.
He claims that a typical example of discrimination by the former management of the Public Prosecutor's Office, Dragan Kovačević, was decided by other criteria, instead of expertise and commitment, during employment.
"Political, kinship, fraternal ties. As for me, I have never had objections to my work in the team, neither from the children, nor from the director, I have always done my job correctly."
Because of everything she went through during her last engagement, she has been seeking justice in court for the last three and a half years. After the fixed-term contract expired and the colleague she was replacing returned from sick leave, she was kept at work with the promise that she would sign the contract.
"I continue to work, they just transfer me to another unit in Humci, I work for another two months without a contract, I receive a regular salary. I came a couple of times for a contract, no one ever handed it to me, but I didn't even sign the decision to terminate the previous one," he explains. Krsmanović.
In the meantime, there was also a competition to which she applied, but there was no place for her among the 43 candidates who got the job. She sued the institution, referring to Article 26 of the Labor Law, which stipulates that the employer is obliged to transform the fixed-term employment contract into a permanent employment relationship if the employee continues to work.
The basic court in Nikšić twice made a decision to return Krsmanović to work.
"They are complaining again. The higher court canceled that request of mine, because I was not hired based on the competition, and the subject of my lawsuit was not the competition but the employment contract."
Krsmanović is disappointed with the court's decision, especially because during the process she managed to prove that the institution forged her signature on the termination of employment.
Due to established irregularities in the work, i.e. during employment, the director of the Prosecutor's Office Dragan Kovačević Radmila Backović was dismissed in January.
The new administration for "Vijesti" Television state how much similar lawsuits have cost them.
"The institution allocated around 48 euros for court cases in the last four years," they said.
They add that in the previous period, two people were reinstated by the court's decision, and that two more lawsuits were filed for the cancellation of the competition and the payment of wages.
