With the positive opinion of the Ministry of Justice, the Prosecutor's Council decided at last week's session that Maja Jovanović, after her mandate as acting VDT expires, can continue to work in that institution as a state prosecutor, even though she came to the Supreme Court from the Higher State Prosecutor's Office.
Considering that decision illegal, the member of the Prosecutor's Council Đurđina Ivanović resigned from the position of deputy president of that body.
Bojan Božović, a member of the Prosecutor's Council in front of the line ministry, claims that the decision is completely legal.
The former secretary of the Ministry of Justice, who before that department was a member of the Prosecutor's Council, Andrej Milović claims that it is a dangerous precedent, which equates the status of the acting president, who is elected by the Prosecutor's Council, with the full mandate of the VDT, who is elected by the Parliament, which Božović denies it.
Božović nevertheless admits that this is a borderline case because, as he clarifies, there is no norm that decisively lists the possibility of continued engagement in the Supreme Prosecutor's Office after the end of the acting state, but he points out that a different approach would represent a high degree of uncertainty for anyone who would potentially be acting VDT- a.
Milović, on the other hand, claims that this decision represents a shortcut to a better job.
And while Milović points out that this decision must be annulled, Božović says that it remains in force.
