The Administrative Court of Montenegro issued a verdict rejecting the lawsuit of the detained former president of the Commercial Court, Blaž Jovanić, against the decision of the Judicial Council, which dismissed him from that position.
On July 1, the Judicial Council dismissed Jovanić, after he had previously been removed from his position as a judge because criminal proceedings had been initiated against him for an act that makes him unworthy to exercise his position as a judge.
The Administrative Court concluded that, according to the Law on Judicial Council and Judges, it was not necessary to conduct a disciplinary procedure beforehand because it is not about determining disciplinary responsibility for disciplinary offenses regulated by law.
"On the contrary, the very fact that the president of the court, who at the same time performed the function of the judge of the court he headed, was temporarily removed from his duties as a judge, has as a consequence the dismissal of the duties of the president of the court," states the ruling of the Administrative Court.
Jovanić was arrested on May 9 and has been in custody since then. The Special State Prosecutor's Office filed an indictment against him on November 8, charging him with having formed a criminal organization in 2015 and for abuse of official position.
