In the continuation of the story about illegalities in the Labor Fund, Television News brings details about how illegal actions related to competitions and appointments were tried to be legalized and what the competent state authorities did.
The state of emergency in the Labor Fund has been going on for a year and a half with no prospect that it will be resolved soon.
Television Vijesti yesterday reported on numerous irregularities of the Fund until June of this year.
In June, the Fund got a new director, illegally, and lawlessness reached its peak. The director is not formally employed at that institution, but receives a salary.
Due to numerous irregularities, the case is being investigated by inspections and the Special State Prosecutor's Office (SDT).
However, the members of the Fund's Board of Directors (BoD) believe that the fact that the media knows about the illegalities is a much bigger problem than the illegal actions, as evidenced by the minutes, which, like other documents in this case, were accessed by a journalist from TV Vijesti.
Vesna Ćalović, close to the Democratic Party of Socialists (DPS), was appointed to the position of director of the Labor Fund in June this year by Nađa Pekić, the deputy president of the Supervisory Board.
Since the deputy did not have the right to do so by law, the Central Register of Business Entities (CRPS) refuses to register Ćalović as a director.
Nađa Pekić did everything to legalize this illegal election, so the first-ranked and second-ranked candidates in the competition for director received a decision stating that they can appeal to the Administrative Court.
However, this court is not competent for disputes of this type, rather it is the Governmental Appeals Commission.
Also, the Board of Directors of the Labor Fund requests, although it is not responsible for this, that candidates submit plans for evaluation, which have already been evaluated before the Human Resources Administration of the Government of Montenegro.
"In this so-called race to sit in a director's chair, one does not look at what will be violated in the meantime or what steps will be taken," pointed out Ines Mrdović from the Action for Social Justice (ASK).
Due to the attempt to illegally enroll Vesna Ćalović in the CRPS, the SDT opened an investigation in the Labor Fund.
From the SDT, from the spokesperson Vukas Radonjić, TV Vijesti received a promise that they would get answers to the questions as soon as they collected the necessary material, which did not happen until the broadcast of this report and the publication of the text on the Portal.
Vesna Ćalović is still not listed as a director in CRPS, nor as an employee of the Fund, according to the data of the Tax Administration, but all the time she receives a director's salary and signs documents as a director since June 15 of this year, which is also recognized by the Ministry of Finance.
"In that context, what are all the legal consequences, including this one, whether she can somehow receive some kind of salary or not, will have to be determined by the inspection authorities," said Boris Marić, Secretary General of the Government of Montenegro.
Due to the accumulated problems, the Government appoints Ana Durković to the position of President of the Supervisory Board. She refuses to sign the minutes on the appointment of Vesna Ćalović and asks for the opinion of the competent state authorities, who have been silent for almost four months.
In a written response to TV Vijesti, Durković admits that she found a complex situation in the Fund, that the SDT is investigating the actions of the Labor Fund, and that Vesna Ćalović, who is still the director, subsequently withdrew her application for enrollment in the CRPS.
The administrative inspection for TV Vijesti announces that it is conducting checks in the Labor Fund in connection with the appointment of Vesna Ćalović.
"We saw that there were no legal prerequisites for the verification of the competition, that is, the election in the competition," said Marić.
After Durković pointed out the problems in the Labor Fund, the members of the Supervisory Board indicate that the fact that the media knows about the illegalities is a much bigger problem than the illegal actions, as evidenced by the minutes in the possession of TV Vijesti. And so Vesna Ćalović, according to the minutes, states that the appearance of information in the media must be put to an end.
Ivana Mihajlović asked for an opinion on how to proceed in the event that inscriptions appear again in the media, and Marina Jovanović demanded that an emergency meeting of the Board of Directors be scheduled if a headline appears in the newspaper again with the mandatory presence of all members.
"They behave that way because the question of responsibility was never raised, because they did not answer. It was up to them to behave as they wanted," Mrdović said.
Although TV Vijesti persistently called and wrote to numerous actors, they did not respond to inquiries and pleas or they decisively refused to respond: CRPS, Jevrosima Pejović, Vesna Ćalović, Nađa Pekić, Darko Stojanović State Secretary in the Ministry of Labour, Minister of Labor Admir Adrović. The spokesman of the Ministry of Labor did not answer any of the six specific questions asked by TV Vijesti, instead they announced, what everyone already knows, that the ministry is a second-level authority.
