Although the government says that the salary increase will not lead to new price increases, lawyers have already established a new price list that predicts a significant increase in the price of their services.
What separates them from that is precisely the consent of the Government, from which they state that they will look at how it will affect the citizens, but also the state, which already allocates millions of dollars for legal services.
Which service prices do the lawyers plan to increase and by how much, and how do they justify it?
Inflation, and with lawyers. If the Government approves, citizens will soon pay twice as much for many legal services as before.
To file a lawsuit for divorce, you had to allocate 125 euros so far, and 250 in the future.
For the help of a lawyer in a labor dispute, instead of 125, the client will have to pay 50 euros more.
Filing a constitutional appeal instead of 300 will cost 500 euros in the future.
All this is stated in the lawyer's tariff proposal, which Television Vijesti had access to.
Lawyer Veselin Radulović says that the tariff had to be changed before.
"It is, of course, a burden for citizens who pay and lawyers, but it is not a burden in that part when you consider, when you bear in mind that this tariff has not been changed for years. Lawyer services in the region, not to mention European countries and countries where the standard is higher, are much better paid,'' pointed out Radulović.
The price, that is, the so-called award to a lawyer for representation in property disputes and due to disturbance of property, could cost 300, but now it is half as low. For drawing up a submission in an administrative procedure or a dispute, instead of 200, it is proposed to increase it to 350 euros.
The new lawyer's tariff was adopted on October 23 by the Board of Directors of the Chamber, stating that it had not been changed for seven years, that inflation and wages were increased through the program Europe now one and two.
"In the text itself, we have left unchanged the amounts of compensation related to disputes of minimal value, in which way we have led to the fact that the increase in the tariff cannot be reflected in vulnerable parts of society, which will continue to be given legal aid at minimal prices", it is written in announcement of the Bar Association
However, Radulović is slow about the way in which the Board of Directors of the Chamber determined the tariff proposal.
He says that the lawyers did not even have the opportunity to see the document and comment on it, which is prescribed by the Statute.
"It is very ugly that we are getting acquainted with the fact that a Draft Tariff has been prepared, that the Minister of Justice has insight into it, and we, as lawyers who are most affected by that tariff, do not have insight into it," said Radulović.
The president of the Bar Association, Danilo Mićović, did not want to speak on this topic until the negotiations with the Government are finished and he directed Television News to the Ministry of Justice. They say they will talk to the Chamber.
"The procedure for obtaining the approval of the Government implies the Government's procedure, which includes the review of the tariff by the Ministry of Justice and the Ministry of Finance, since the Lawyer's tariff as a regulation has an impact on citizens and the business environment, and for the ex officio defense, free legal aid and on the Budget" , said Momir Jauković from the Ministry of Justice.
An increase in tariffs was also proposed in criminal cases, as well as in cases that are assessable. However, there are also reductions in the prices of services, but in favor of the state. The state pays millions in costs due to the administration's silence and abuses. That is why the Chamber proposes that, in the future, instead of 200, 100 euros per submitted submission will be charged for these disputes.
"I don't see any reason why it was decided that way. It is probably working on some kind of positioning in those negotiations with the Ministry of Justice," Radulović said.
Since the state has been losing disputes for years, especially in labor relations, and for that it pays millions for legal services, if something is not done about it soon, it will allocate much more in the future.
