In the end, 93 percent of viewers, via the Televizije Vijesti Megafon app, voted that after August 30th, not everyone is equal before the law.
Komnenić asked what would happen to the land and what the state's position was, to which Živanović said that there were two options, one of which was to make a compromise with compensation to the state for the period during which the rent was not paid at the market price on the day the assessment was carried out without considering who had increased the value of the land, but that all of this would be preceded by the outcome of the criminal proceedings.
Komnenić pointed out that the state can be charged ten years in advance, and if the procedure goes in favor of the Carevićs, it can only be charged three years in advance.
"I propose that the court make a decision to shoot me," said Carević.
He asked Komnenić how he was not embarrassed and why he did not write about "Mia Investment" in Budva "where his friends are involved", to which he replied that he had attacked them in 2019 and Carević had established cooperation with them, and that he would play a recording in the next show where Carević praised the company.
Milovac pointed out that Carević offered a way out in 2020 and that he was pursuing a strategic development of Montenegro's agriculture, and that he offered to demolish the facilities.
Carević said that he saw a way out in having Komnenić and Milovac come to his farm and see "how it is done in European countries."
"The very fact that I have been waiting for the state for nine years is an indication to investors and businessmen," stated the former mayor of Budva.
Živanović pointed out that in 2021, the inspection went out into the field and banned construction.
Milovac said that his NGO filed two criminal charges against former Minister of Capital Investments Mladen Boajnić because he allowed the application for the Carinvest concession, headed by Carević, to be accepted.
"In that competition, the state also offered property that was not state property but belonged to Mr. Carević, which is a conflict of interest," he pointed out.
Carević pointed out that only the future concessionaire can be the initiator.
"There are tenders. What is Carinvest? The best bidder," he said.
Milovac said that the Asfalt Beton company had 13 contracts with the Budva municipality while Carević was at the helm of Budva, and that Carinvest was a supplier for that company.
The show played a recording in which Carević makes a statement as the mayor of Budva, while a Carinvest excavator is working behind him.
"I have been a businessman for 30 years. You are a disgrace to this society," Carević said to Milovac after he was asked how much he received from the 2.6 million Asfalt beton that the company received from the Budva municipality during his mandate.
Komnenić said that the proceedings against Carević and his son proceeded "magically" because the case was time-barred due to the inactivity of the prosecution, and that the Supreme Court's analysis of the actions of the Basic Court in Kotor will be heard, but that he also has a letter from MANS from 2021, when it was replied that the decision would be made quickly.
Milovac said that MANS submitted the application in 2020.
"The protector of property and legal interests says that acting within the framework of the law can only benefit Carević," he pointed out.
Carević said that many people have been given land for lease, and that he is the only one who has been waiting for so many years.
"What kind of law and state is it - that's not my question. If someone has issued a ban on me, let them contact me. I worked like 200.000 builders in Montenegro. These are barns," he pointed out.
Milovac replied that the investigation has been going on for years.
Komnenić aired a report on the Supreme Court's announcement regarding the actions of the Basic Court in Kotor.
The report points out that the main trial consisted of 20 hearings, of which 10 were held, and that it was postponed due to the defendant's request for religious reasons, the expert witness's inability to return the case files, the request of the Kotor District Prosecutor's Office...
As stated, insufficient activity of the judge was observed in relation to the expert examination procedure, as well as insufficient activity of the expert witness because the expert examination procedure lasted for more than a year, after which it was determined that the expert witness was not on the list of expert witnesses, so it was assigned to a new expert witness who completed the same in four months.
Komnenić then showed photographs of Judge Veljko Bulatović, who assigned the expert witness to a person who is not on the Ministry of Justice's list of experts.
Carević added that he knows expert witness Čepić, and that he is not on the list because his license has expired.
Komnenić pointed out that Judge Bulatović singled out Ploče beach from the Maritime Dobro.
Carević said that he has villas and a restaurant on his land, and that he has increased the value of state-owned land.
"The price is determined by the planning document - whether it is urban construction land, whether it is road infrastructure, whether it is agricultural," he pointed out.
Komnenić said that Carević is offering 1.93 euros per square meter for the purchase.
Živanović pointed out that the state did not react as quickly as Carević expected, but that the inspection was asked to gain insight into the situation on the ground.
"The lease of state land is carried out on a competitive basis and is equally available to everyone," he pointed out.
Komnenić played a recording from the archives in which Carević says in a show that, as the newly appointed president of the Budva Municipality, he invited the then Prime Minister Duško Marković to open cooperation "as if they were one party."
"While I was mayor of Budva, something was happening. Look what's happening now. You're scared, Petar. You are mercenaries of foreign embassies and nothing that is good for this country suits you," said Carević.
"The damage from the years-long usurpation of land in Krimovica since 2015 has not yet been assessed, and the criminal report filed by your predecessor only covers Carević and his company. Who should compensate the state for what Carević used for free?" Komnenić asked.
Ćirović pointed out that the Carević company does not have a contractual relationship with the state and that this is illegal exploitation by them and that the land in question is being used for the company's profit. The damage has not been assessed to date, but that it will be in the future, after the completion of the criminal proceedings, but in any case it would consist of non-payment of compensation for construction on that land.
She added that the assessment would be made at the price from the period when the lawsuit was filed.
"The criminal proceedings themselves - we initiated them precisely because they involve illegal actions and criminal acts. We have a first-instance decision that was also overturned by the company that is exploiting the land. We would like to see the land returned to its previous state. It is over half a million square meters," she pointed out.
When asked whether anyone had proposed a ban on disposing of the property while the trial was ongoing, Ćirović replied that no one had.
"That measure had its purpose when the statute of limitations expired, not after 10 years. Today, given the situation that the land is owned by that company in terms of the built facilities in which the activity is carried out, that the company has permits and employees who perform that activity, it was not appropriate to propose such a measure because the measures are determined at the expense of the person proposing it, so we would be liable for some damage. I have no information that the Kotor Public Prosecutor's Office proposed that," she said.
When asked how they are on the V list, she replied that it is according to the Law on State Property, Article 64, or the Law on State Survey and Cadastre, according to which, with a statement made to a notary, a property can be registered on state property.
When asked by journalists that four governments had changed without any reaction from the construction inspection, she said that this was the reason for their interest and filing the application in 2019, and the process only began in 2024 at the Basic Court in Kotor.
"We are in the process of considering what to do about some people who missed supervision, taking into account the passage of time and the behavior of the Kotor Public Prosecutor's Office," said Ćirović.
Ćirović explained that he is asking the court to oblige Carević, as the defendant, to pay compensation for the land, and that in her eyes, Carević is a usurper of state land.
"How did you get money from the Investment and Development Fund (IRF) to build illegally on state property if you were in the state's disfavor? And the head of the IRF was Zoran Vukčević, who is being sued together with Petar Ivanović in the Abu Dhabi Fund affair?" Komnenić asked, to which Carević replied that his company had always been on the tax white list.
The former first man of Budva said that the state was the biggest beneficiary of his land because it generated a million euros in revenue, and that if it wanted to do its job, he would have a lease agreement.
"I had three urgent matters with Blaž Šaranović, the then head of the State Property Administration. I was in the old government building 20 times, insisting that we resolve this relationship according to the principle you gave Čelebić," he said, adding that the state had collected 661.000 euros in taxes, and that his company had paid 1.750.000 in taxes for one year.
Komnenić played a recording of a conversation with the Protector of Property and Legal Interests of Montenegro, Bojana Ćirović.
"There are documents that you signed and statements that you made - that I usurped 600.000 square meters and that I built illegal buildings there that I would like to legalize. That doesn't mean that you are right and that you are good. It just means that you have to enter the framework of what the system is, what is right. The fact that the state tolerated you speaks volumes about the state itself. You present yourself as a host. A true host does not harm his state," Milovac said, adding that no one can convince Carević that he committed a crime.
The former mayor of Budva pointed out that the restaurant is not usurping state land, but in order to get to state land, one must pass through his family's land.
Komnenić stated that Carević traded with former federal president Svetozar Marović and played an archival recording in which he says that Marović asked him to give him stone from the quarry, and that he would get the jobs that Gugi Komerc got.
When asked how he got the money to build on state property, Carević replied that "unfortunately for Komnenić, he is a businessman."
Komnenić pointed out that Carević's trial is outdated, but it is not a trial against his son.
Milovac added that it is about 620.000 square meters.
"It's like someone stole a car, you sue them, and they come to trial in that car," he pointed out, adding that the infrastructure has been broken into, olive trees have been planted, and that Carević was registered as an olive grower in 2020, and that in 2016 he received permission to enter the register of agricultural producers.
The MANS representative pointed out that Carević received a permit for agricultural activity for land that he owns, but that he is carrying out the activity on state-owned land that he has usurped.
Carević said that it was his grandfather's property, to which Milovac replied that if his grandfather had left him something, he would not have tried to buy it from the state. The former first man of Budva replied that it was manipulation.
"You write in your request for legalization that you have leased it," Milovac pointed out.
"At the same time, the Čelebić Company - the same project is taking place behind Bigova. It received the papers in four months. How do you explain that?", asked Carević, adding that he explains that it is due to political affiliation, and that he has never been a member of the party.
When Komnenić stated that he was the leader of the Democratic Front (DF) list in the local elections in Budva, he said that he was, but that he was not a member.
Komnenić added that Carević, as the president of the Budva municipality, usurped the land.
Carević pointed out that he had taken a geodetic survey, had received approval from the Ministry of Agriculture, and had he been on good terms with the state, he would have received the papers in four and a half months.
Komnenić stated that he is sending a message to every Montenegrin that the land is being usurped, and that he is earning income from that land because he has a private business on it.
When asked where the construction inspections are, Živanvović said that it is up to the state and the competent authorities to determine.
"Regardless of who is involved in the procedure, the Government is the collective body that decides on the transfer of state land," she pointed out.
Carević said that Milovac stated that he had built a restaurant on state property, and that the permit for operation states that it is located on a plot owned by his family, while there are only stables on state plots.
Carević said that he pays taxes on that property, and that the problem is that there is no planning documentation.
The former mayor of Budva said that the address began at the lowest levels - the local community.
"In 2015, I approached the Minister of Agriculture, Petar Ivanović, and I even asked people to go out into the field and show them what I wanted to do, and to tell me if they could," Carević said, showing the documentation, adding that the department thanked him and asked him to complete the documentation.
Komnenić pointed out that the Tsarevich was pretending to be in the state's disfavor.
The host showed a photo of former Minister of Agriculture Aleksandar Stijović, who was a guest at Carević's goat farm.
Živanović assessed that the case of the Carević family has been known to everyone for the last ten years, and that he is one in a thousand illegal builders.
When asked if he was a prominent businessman or a land usurper, she said that the land was definitely usurped.
Milovac said that he had a clear position on the matter, and that there was already a verdict that was overturned, and that the cadastre had determined that Carević had built illegally, and that the former mayor of Budva himself had stated several times that he had built illegally.
Carević said that it was a bit sad that he was trying to be presented as a wild builder, and "half of Montenegro is fenced off", to which the host and editor of the show Načisto Petar Komnenić said that "half of Montenegro, half a million square meters, is not fenced off".
"I came for the citizens, not for you," said Carević and told Komnenić that he was trying to spin.
Carević pointed out that he was not a wild builder, to which Komennić showed him a statement made by him to a notary in which he admitted this.
Milovac showed the same document and added that there was not one, but 6.000 buildings in that area.
When asked by Carević why the state registered the buildings, Milovac replied "because the state is falling apart", to which the former first man of Budva reacted by saying "that's not his problem".
