The Luxembourg-American company Corporation America Airports said that the second scoring for the technical part of the bids in the tender for concessions for Montenegrin airports was illegal, and therefore the scoring of the financial bids was also illegal, Televizija Vijesti reported.
In a letter to the President of the Tender Commission, Niko Đeljošaj, sent on June 13th and never received a response, the company stated that the financial offer of their competitor for the airports, the South Korean company Inchon, should not have been considered because they did not receive the required 80 points in the first scoring for the technical part of the offer.
They claim that the Tender Commission, under pressure from outside, then changed the initial scoring and awarded Inčona 81,69 points.
"In both scorings, the same documents were evaluated by the same members of the Tender Commission and it is legally unacceptable for the same documents to be evaluated differently in two different scoring sessions, in a formal-legal procedure such as that under the Concessions Act," the Luxembourg-American company stated, adding that the Concessions Act does not provide for repeated or consecutive evaluations or scorings.
They conclude that the Tender Commission was established as an independent and professional body, and its role becomes meaningless if it is unable, as in this case, to make decisions autonomously.
The Chairman of the Tender Commission for Airports, Nik Đeljošaj, has scheduled a new session of the Tender Commission for today, which ultimately rated Inchon's bid as the best, receiving 96,18 points, while Corporation America Airports received 65,18 points. The deadline for the Commission's decision and sending the report to the Government expires tomorrow.
