The Concessions Commission of the Government of Montenegro has rejected the proposal of Corporación América Airports to suspend the further course of the tender for the award of concessions for Montenegrin airports, the Concessions Commission announced to Television Vijesti.
The Luxembourg-American company, which ranked second in the tender, behind the South Korean company Inchon, requested a postponement of the final decision on the tender until the Administrative Court rules on their lawsuit, which they announced.
However, the Government Commission for Concessions assessed that the request was unfounded and without any basis in law, because the disputed decision is not enforceable.
The Commission also determined that Corporacion America Airports did not prove the existence of irreparable damage, because any financial losses and lost profits can be claimed through compensation for damages, while the disputed decision does not affect their reputation or the right to participate in further proceedings.
The postponement would be contrary to the public interest, as it would unnecessarily prolong the tender and jeopardize legal certainty and the public interest, the Commission concludes, adding that the Luxembourg-American company may, in a lawsuit before the Administrative Court, propose a postponement of the execution of the disputed act, which the court will decide on, if the legal requirements are met.
