The Luxembourg-American company Corporacion America Airports (CAAP) filed a lawsuit with the Administrative Court of Montenegro against the tender commission for the award of the concession, requesting that the actions of the Commission for the Award of Concession for Montenegrin Airports, which, as they believe, changed the scoring criteria under the influence of parties that are not members of the Tender Commission, be declared unlawful.
They are also demanding that the Tender Commission's first evaluation of the technical bids be declared legal and the only relevant one in this procedure, the company told TV Vijesti.
They believe that, accordingly, that company should be the first and only ranked bidder for the concession of Montenegrin airports, and not the South Korean company Inchon, which was ranked first according to the Commission's decision.
The lawsuit contains numerous reasons, including the opinion of one of the leading law firms in Brussels, with extensive experience in the field of public procurement in the EU, which concluded that the Tender Commission's actions regarding the re-evaluation of the bids violated the legality of the tender procedure, which is why they request that the Administrative Court postpone any further action regarding the tender until its decision is made.
The government's Concessions Commission rejected the request from the Luxembourg-American company yesterday.
