Aco Đukanović's lawyers do not know what is written in the folders seized during the search of his apartment in Podgorica, Đukanović's defense attorney Nikola Martinović told the show "Načisto" on TV Vijesti.
He also questions the fact that some politicians are arguing about it.
Martinović also points out that the lawyers did not attend the search of Đukanović's apartment in the center of the capital.
"The defense has no idea what is written in those documents. So, the record describes the name and form of where those documents were found, but the content was not discussed, because that is not discussed in the trial, that is a question for the further course of the procedure. So, some documents were found there, but it does not say anywhere what the content of those documents is. I am also surprised by the controversy that started yesterday, that some people, who cannot in any way have any say in the content of those documents, are commenting on the content of those documents," said the lawyer.
He said that the legal team has no real possibility of knowing what is in those documents. Editor and host of the show "Načisto" Petar Komnenić asked him why they call it a "pamphlet" then.
"Because the title of those documents indicates that they are some kind of pamphlet. And you can see that from the search report and the certificate of seized items. There you can see that they are some pamphlets. And that is the name for the title of the document. What is the content? No one from the defense knows," Martinović added.
Komnenić noted that Đukanović's legal team does not know at this time whether these legally exempted documents could still be incriminating...
"In those documents, there may be, I don't know, that Aco Đukanović wanted to buy an atomic bomb, but let me tell you one very rational thing. As a result of that search, Aco Đukanović or anyone from his defense was not invited to say a word. Which leads me to some, let's say, rational claim that the prosecutor, who that same evening must have been familiar with, let's say, the things that were found in the search, did not find it appropriate to even ask what it was about," the lawyer said.
"He's not crazy to run away"
Djukanovic, who was arrested last week, has been remanded in custody on suspicion of committing a criminal offense - the illegal possession and carrying of weapons and explosives.
Martinović said that it is clear that Đukanović "is not crazy" to flee Montenegro and abandon his capital.
He points out that Đukanović does not live abroad, but was there due to his and his wife's health problems.
When asked whether Đukanović has permits for the weapons found, he answers:
"For a weapon to be in illegal possession, you have to know about it. Clearly, Aco Đukanović did not know about it. Some of the weapons, as the prosecution stated, have expired permits. Those permits are in the name of his late father. I am sure that some of the rifles found there have permits in the name of Aco Đukanović, but they have expired."
It will be interesting, as he said, how it is possible to confiscate a weapon that has not been modified, without the Ministry of Interior saying that it is in the records.
"In my opinion, there is a rifle that does not have a license for Aco Đukanović, that is for sure. It is a rifle on which there is a dedication to his brother. Aco Đukanović does not have a license for that rifle, I think he cannot have one, judging by the dedication," said Martinović.
The police searching the apartment in Podgorica, the lawyer says, listed in detail several weapons, "which could be used to equip a small police and military unit", helmets, bulletproof vests, police and military uniforms, and "the exact locations where they are probably located".
"But if you have the fact that you have detailed descriptions of weapons, equipment, uniforms and their locations, and you have absolutely nothing of that, then it is clear that this operational source is unusable."
It is clear, he said, that the police violated a basic rule in police work with operational sources - to check the credibility of that source and to check whether the information they have from that source relates to that apartment or another, and to what time period it relates.
Komnenić asked who the legal team suspects is the source of the information, possibly Ana Pešukić, who has already publicly accused Đukanović, who looked after his children and who is accused of stealing jewelry from his apartment.
Martinović said they do not know who the source of the "obviously false" information is.
"Like you, I can conclude from public sources that one of the sources may have been Ana Pešukić, but she is not a credible source for the situation in Aco Đukanović's apartment in 2026."
Komnenić recalled that Miodrag Daka Davidović attended the search in Nikšić and asked Martinović if Đukanović had anyone closer to Davidović.
"I am Aco Đukanović's lawyer, I am not a priest, I do not interfere nor do I care whether someone is someone's godfather, business partner or neighbor. It is true that Davidović was a witness to the search of the house in Rastoci," the lawyer replied.
