The Higher Court in Podgorica has sentenced 45-year-old IM from Podgorica to five years in prison for breaking into a snack and candy machine at the Institute for Children's Diseases.
In this way, the judgment previously rendered by the Basic Court was confirmed.
Television Vijesti has learned that in March the High Court rejected the appeal of the defendant and his lawyer as unfounded.
Two days ago, Television Vijesti published a story about this case, which raised the issue of the uniformity of penal policy in Montenegro, given that the judges of the Special Department have not yet imposed a five-year prison sentence on those who abused their official position while holding the highest state positions.
However, the High Court assessed that in the case of the theft of products from an appliance worth 235 euros, the Basic Court correctly applied the law and, due to the defendant's previous convictions, lawfully imposed a sentence above half of the prescribed range for this criminal offense.
