The race for the new convocation of the Prosecutorial Council is being fought on three fronts, as advertisements are currently being published for representatives in this most important prosecutorial body, both from the prosecutorial organization and for reputable lawyers who are not lawyers, but one representative each from non-governmental organizations and the Bar Association.
The current term of office of the Prosecutorial Council expires on August 5 this year, and according to the Law on the State Prosecutor's Office, it is clearly stipulated that three months before the expiration, the Parliamentary Committee for the Political System, Judiciary and Administration is competent to publish public calls for members from among prominent lawyers and NGOs, the prosecutorial organization selects its own, while the Bar Association is obliged to publish an advertisement for its representative in that body.
The selection committee has compiled a list of candidates who will be voted on today at the Conference of State Prosecutors, which is scheduled for 11 a.m., at which all prosecutors present will have the right to elect one of the two proposed representatives of the Supreme State Prosecutor's Office, the Special State Prosecutor's Office, and the higher and basic prosecutor's offices by secret ballot.
From the ranks of basic prosecutors' offices are: Jelena Vučetić, Ivan Gacevic, Vojislav Grujić, Danijela Đuković, Maja Knezevic.
The list of candidates for members of the TS from the Supreme State Prosecutor's Office, the Special State Prosecutor's Office and two higher prosecutor's offices in Podgorica and Bijelo Polje includes: Marko Bojović, Lidija Vukcevic, Zoran Vučinić, Jelena Djaletić, Ana Marinović, Biljana Medenica, Vukas Radonjic i Ljubica Caković.
The head of the Higher State Prosecutor's Office in Podgorica was previously appointed to head the Selection Commission. Beautiful Medenica, with two members and their two deputies, and the composition was determined at an extended session of the Supreme State Prosecutor's Office.
The Conference of State Prosecutors, which consists of all heads of state prosecutors' offices and state prosecutors, is convened and chaired by the Supreme State Prosecutor. Milorad Marković, and decisions are made by a majority vote of the members present.
The list of 12 candidates has already been compiled by the Selection Commission, based on the notification of proposed candidates, whose names were selected at sessions of prosecutors' offices or based on initial proposals from all basic prosecutors' offices.
The Prosecutorial Council has a president and ten members. The president of the TS is the Supreme State Prosecutor, and five are prosecutors, two eminent lawyers who are not lawyers, a representative of the Ministry of Justice, a eminent lawyer representing an NGO in the field of the rule of law, and a eminent lawyer from the ranks of lawyers.
There is no competition for prominent lawyers
Only two applications were received in response to the public call by the Parliamentary Committee for the Political System, Judiciary and Administration for the election of two members of the Prosecutorial Council from among reputable jurists who are not attorneys.
As "Vijesti" learns, the candidacies were submitted by lawyers - the secretary at the Faculty of Political Sciences. Sekule Raičević and public bailiff from Bar Veselin Scepanovic.
This public call for distinguished lawyers received surprisingly few applications, given that some previous procedures for representatives on the TS or the Judicial Council had as many as 30 candidates apply.
Only someone over 40 years of age and 15 years of work experience as a judge, prosecutor, lawyer, notary, public bailiff, professor of legal sciences can be elected as a distinguished lawyer...
Lawyers await photo finish
In response to the public call of the Bar Association, which was published in the Official Gazette of Montenegro on June 12th of this year, none of the lawyers with over five years of experience have yet responded. isexperience in that profession did not send a candidacy.
The public call expires on June 23rd of this year, and judging by previous advertisements, lawyers who want to be members of the TS will most likely wait to submit their application towards the end of that deadline.
The Board of Directors of the Bar Association decided at its meeting on May 28, 2025, to re-announce a public call for the election of one member of the Prosecutorial Council from among lawyers, but this time due to the expiration of the mandate of the current convocation.
