Democratic Party of Socialists (DPS) MP Oskar Huter, member of the Council for Citizen Control of Police Work Aida Petrović, and Iva Nešić are among 35 people who were prosecuted for disturbing public order at a protest in front of Vila Gorica in early July.
Nešić, the police announced, was extinguishing a cigarette ember on the protective equipment of police officers, which was recorded on video and posted on social media.
The protest took place on July 8, 2025, during the ceremony to award the July 13th Award. The Police Directorate states that an unregistered gathering of citizens was held at that time, organized by the NGO Stega, during which public order and peace were disrupted and police officers were actively attacked by the crowd.
The police announced that the state prosecutor at the Basic State Prosecutor's Office in Podgorica, after reviewing the entire case file, stated that the actions of the identified persons do not constitute the elements of a criminal offense that is being prosecuted ex officio, and that police officers appreciate the existence of misdemeanor liability of the identified participants in the event.
"Police officers of the Podgorica Security Department, taking measures and actions within their jurisdiction, assessed that the actions of the aforementioned persons constitute elements of a misdemeanor, which is why they submitted requests to the Misdemeanor Court in Podgorica to initiate misdemeanor proceedings against 35 persons on suspicion of having committed misdemeanors under Articles 11 and 12 of the Law on Public Order and Peace (obstruction, disrespect and failure to act on the orders of police officers)," the police announced.

The Police Directorate will, it is added, act in an unselective and objective manner in accordance with the law and work to identify every person who commits a misdemeanor or criminal offense, regardless of the persons involved and the type of public gathering, and protect public order and the constitutional order of Montenegro.
"Police officers will continue to work continuously to maintain stable public order and peace, prevent the commission of criminal offenses and misdemeanors, protect the safety and property of all citizens of Montenegro and ensure the rule of law, as well as detect and prosecute persons whose actions disrupt public order and peace, provoke or incite violence and illegal behavior. Also, the Police Administration will inform the Council for Civilian Control of Police Work by an official letter about the reasons for initiating misdemeanor proceedings against a member of the AP Council in order to take measures and actions within the jurisdiction of the Council," the police announced.
Following the announcement by the Police Directorate that 35 people, including Petrović, were prosecuted for disturbing public order at a rally in front of Villa Gorica on July 8, 2025, the Council for Citizens' Control of Police Work convened an emergency session for December 10.
"On this occasion, the Council requested from the Director of the Police Directorate a copy of the case file with the evidence on the basis of which the report was filed in connection with the case in question," the statement reads.
