The indictment of the Special Prosecutor's Office in Pristina states that the defendants for the attack in Banjska aimed to secede the north of Kosovo and annex it to Serbia and that the group was organized in October 2021 at a meeting attended by the President of Serbia, Aleksandar Vučić.
According to Koha, who had insight into the indictment, it appears that the group began to organize in October 2021 at a meeting attended by President Vučić, and Serbia offered the group's leader, Milan Radoičić, the necessary military infrastructure for training participants.
According to this media, the indictment of the Special Prosecutor's Office does not directly implicate the Serbian state in the organization of the attack in Banjska. However, in this document, which was obtained by Koha, it is emphasized that the group of Serbs had the goal of seceding the north of Kosovo and annexing it to Serbia.
"Acting according to well-organized preparations and plans in advance, using violence and heavy weapons, they tried to secede the northern part of the territory of the Republic of Kosovo, more precisely the municipality with a Serbian majority, and annex that part of the territory to the Republic of Serbia," the indictment states.
The indictment is filed against 45 defendants: MR, BS, VT, DM, VR, UJ, MJ, VA, AM, L.Š, V.Đ., VV, SJ, MK, UM, TV, DV, VJ, SP, NS, MV, SR, MR, MA, Ž.C., KD, SM, MS, AJ, RG, IM, GZ, NR, RA, MM, Đ.B., DGDV, AT, MK, MN,, NI and VI
"Most of the group, after they entered the territory of the Republic of Kosovo from the Republic of Serbia through illegal routes, with dozens of vehicles, some of which were armored, loaded with heavy weapons, ammunition, rocket launchers, explosives, camouflage military uniforms and logistical military equipment, first they blocked the road at the bridge in the village with two trucks, then they hid and took positions. When the officers of the Republic of Kosovo police came to remove the trucks and clear the road, they attacked them with explosives and heavy weapons, while at the bridge in the village killed policeman Afrim Bunjaku," the indictment states.
"The attack lasted until 15.00:XNUMX p.m., when the majority of this group fled towards the mountain roads in the direction of the Republic of Serbia, all with the aim of seriously destabilizing and destroying the basic political, constitutional, economic and social structures of the Republic of Kosovo," it added.
The main accused is Radoičić, and according to the indictment, Koha writes, there is a well-founded suspicion that he committed the criminal offense of "facilitating and financing the commission of terrorism."
"In the period from 2017 to September 24, 2023, the accused Milan Radoičić, as the leader of an organized terrorist group, obtained funds indirectly, most of which were used for heavy weapons - the purchase and supply of heavy weapons for the terrorist group, military uniforms - providing uniforms for group participants, logistical support - provision of equipment and logistical services for group operations, payment of group participants - funding of terrorist group participants to ensure their continued involvement and engagement in criminal activities, which was aimed at facilitating and financing terrorist acts, i.e. creating the necessary capacities for the execution of terrorist acts," the indictment states.
One part of the indictment talks about the financing of the group that carried out the attack.
According to the scheme presented in the indictment, the criminal activities of Radoičić were financed from two main sources: the abuse of tenders from Kosovo and from the state of Serbia.
"The first form of financing, by abusing tenders from Kosovo that were of low value, took place by obtaining contracts that were procedurally legal, but after obtaining the contract, the project was not implemented or was not realized at all. The second, that is, the main form of financing, with a huge amounts of money, it came from Serbia, where this form functioned on behalf of the so-called Office for Kosovo and Metohija," it is stated.
In the indictment, the main responsibility for strengthening Radoičić was attributed to Serbia.
"During the investigation, it was established that the strengthening of the accused Milan Radoičić was carried out in various ways with the direct support of the Republic of Serbia, which first provided him with economic support through the awarding of tenders in Serbia, with the aim of collecting significant funds, i.e. support worth millions of euros, then political support at high-level meetings of the security and political structures of the State of Serbia," the indictment states.
According to the indictment, the details of which are presented by Koha, Serbia, among other things, provided Radoičić with the necessary military infrastructure for the training of participants.
"After that, Serbia provided him with all the necessary military infrastructure for the training of participants, the provision of military equipment and logistics, everything necessary for the execution of a terrorist attack on September 24, 2023 in Banjska near Zvečan. Kosovo for the accused Radoičić was realized by opening a company in a legal way, with the aim of concealing the origin of the money or masking its origin, so that everything would look legal in the eyes of the public and the official authorities indictments of the Prosecutor's Office.
"In addition to strengthening and political support, with the aim of influencing the Serbian civilian population, the accused Radoičić was given support by placing him in key positions with the aim of creating the main figure in the north, and through those positions the citizens of this part of Kosovo were controlled. The positions that the accused Radoičić occupied were the vice-president of the 'Srpska lista' party, the president of the so-called Football Federation of Kosovo and Metohija in the parallel system of Serbia and the president of the so-called Club Trepča in the parallel system of Serbia," it is stated.
Based on the indictment, the group began to organize at a meeting held on October 13, 2021 in Raška, at which, according to Koha, President Aleksandar Vučić and Milan Radoičić, who claimed responsibility for the attack, were also present.
"During the meeting, they demanded arming and the beginning of armed resistance against the institutions of the Republic of Kosovo in four northern municipalities, such as Severna Mitrovica, Zvečan, Leposavić and Zubin Potok," the indictment states.
The document points out that from December 2022, and during 2023, there were increased attacks with firearms on the police and other institutions, on the media and journalists, barricades and explosive devices were placed on them, and attacks were also carried out on members of KFOR.
The indictment refers to the collected evidence that shows that on the day when the KFOR soldiers were attacked, Radoičić was in Kosovo with other armed Serbs and was ready for an armed attack.
"This state of readiness of the group was a preparation for carrying out an attack during the protest announced by the Serbs for May 29, 2023, in which violent Serbian demonstrators attacked KFOR in front of the Municipal Assembly building in Zvečan with weapons, explosives, Molotov cocktails and hard objects, as a result of which more than 90 KFOR soldiers were injured, including some with serious physical injuries," the document states.
The indictment contains evidence of all the movements the group made on the day of the attack in Banjska.
The beginning of the implementation of the plan for the attack began at 02:09, when two trucks entered the village of Banjska, which the group used as barricades before the start of the attack. The distribution, however, came about 13 hours later.
It is stated that not all participants in the attack fled to the nearby mountain.
The indictment analyzed footage of the movement of the "Mercedes" car, which proved that armed and uniformed members of the group were transported in it.
Based on records in the database and CCTV footage from the Jarinje border crossing, it can be seen that it was with this vehicle that the accused NI left Kosovo and went to Serbia at 17.32:25 p.m. on September 2023, XNUMX, the day after the attack.
However, three participants in the attack were arrested in Kosovo.
One of them, VT, decided to defend himself by remaining silent and did not want to speak before the prosecutor.
Two of them, it is said, still spoke. BS stated at the police station in Mitrovica that the day before the attack he went to Raška, where he met with two other accused persons, and that they headed towards the village of Banjska in an organized manner with three or four cars.
