The Court of Appeal in Belgrade has returned to retrial the lawsuit filed by Andrej Vučić, brother of Serbian President Aleksandar Vučić, against the editorial staff of the newspaper and portal "Nova" for publishing the column "Andrej's First Billion for Our Triple Jump".
As reported by the Nova.rs portal, the verdict of the Court of Appeal in Belgrade followed an appeal by Nova's lawyers against the verdict by which the Higher Court convicted the editorial staff and journalist of Nova, and at the same time compensated the brother of the President of Serbia with 100.000 dinars.
The reasoning of the Appellate Court panel, consisting of judges Jelena Stevanović, Jasmina Vukovljak Jovanović and Marina Brkić, states that the first-instance, Higher Court in Belgrade, significantly violated the provisions of civil procedure, and that the reasons stated in the reasoning of that verdict are "unclear and contradictory", and that "reasons were not stated" for all the important facts.
"Furthermore, due to the incorrect application of substantive law, the factual situation has not been fully and correctly determined," the Court of Appeals' verdict states.
The trial, therefore, will begin again in October of this year, before the High Court.
Andrej Vučić sued journalist Jelena Bulajić and the editors of the newspaper "Nova" and the portal Nova.rs for publishing a column entitled "Andrej's first billion for our triple jump", in which the author discusses findings previously published in the Independent daily (ND) Vijesti about the "sky" correspondence of members of the "Kavach clan". The Vijesti article "Zvonko and Andrej celebrated a billion..." quotes a message from Ljubo Milović, a member of the clan, who writes: "They say Zvonko and Andrej celebrated a billion almost", alluding to Andrej Vučić and Zvonko Veselinović.
Vučić also sued Vijesti for publishing this text, and the process is still ongoing in the Podgorica court.
