Donald Trump's lawyers have sought to overturn a New York criminal conviction he received for concealing payments to porn stars.
In seeking the reversal, he cited a recent US Supreme Court decision that recognized a wide range of immunity for former US presidents.
America's highest court, with a majority of conservative justices, on July 1 recognized the president's limited criminal immunity, a victory for Donald Trump, who faces four criminal cases months before the presidential election in which he is seeking re-election and should face a Democratic rival, current head of state Joseph Biden.
"The jury's verdict should be reversed and the indictment dismissed," Trump's lawyers wrote in a filing Friday to the judge in charge of Trump's trial in New York, Juan Mercan.
Trump was convicted on May 30 of 34 counts of falsifying documents to cover up a $130.000 payment to porn actress Stormi Daniels in 2016 to avoid a scandal at the very end of his then-election campaign in the race for the White House, which he won.
The New York trial was historic because Trump became the first former US president to be found guilty in a criminal trial.
The sentence in that case was supposed to be handed down on Friday, but it was postponed due to the Supreme Court's decision. Judge Mercan said that he will decide on the annulment request on September 6. If he rejects that request, Trump will be sentenced on September 18.
Manhattan prosecutor Alvin Bragg has already said in court that he is not opposed to the postponement of the sentencing, with the assessment that the convicted Trump's arguments for annulment of the sentence handed down to him are groundless.
