I did not tell you that the 42nd Government of Montenegro, glory and grace, at the 62nd meeting held on March 10 of the current year, after adopting the Information on the implementation of the Komarnica HPP construction project submitted by the Ministry of Capital Investments, made a Decision on granting a concession for the use of natural wealth, for the purpose of construction, maintenance and use of the energy facility of the Komarnica hydroelectric power plant, etc. (SLCG 29/22, dated March 18, 2022).
At the same session, the government accepted i Proposal for a concession contract, related to the aforementioned decision. In the role of the Grantor, the grantor of the concession on behalf of the Government of Montenegro, none other than li appears in the Contract Proposal Mladen Bojanic, (former) Minister of Capital Investments, and in the role of Concessionaire, recipient of the concession, in front of the economic entity entitled Elektroprivreda Crne Gore AD Nikšić - the national electric power company - appears none other than li Nikola Rovčanin, executive director (a player from the camp Alekse Bečić).
In order to avoid confusion, the Grantor and the Concessionaire are referred to individually as "Party" in the text of the Agreement, and together as "Parties".
Further, (Definitions and interpretations, Article 2 - which is also my favorite article of the contract), says (2.1): "In the interpretation of this contract, unless the context requires otherwise, the following rules will be applied:/ - words in the singular will also include their plural, and words in the plural will also include their singular;/ - words of any gender will also include other gender" etc. - which is not so important, of course - but it is sweet - and what is important is that Article 3 (Implementation of the contract) says (3.1): "The concessionaire undertakes to undertake actions and fulfill the parameters from the Technical Resolution of the Implementation Plan, which is divided into the following phases:/ 3.1.1 Phase I - the phase of the preparation of technical documentation, including the preparation of project documentation, the preparation of studies on environmental impact assessment and the preparation of other documentation in accordance with the regulations, which starts from the date of conclusion of the contract and ends with the date of issuance of the Building Permit ” etc.
I dug up and that the Secretariat for Spatial Planning, Communal Housing Affairs, Property and Economy of the Municipality of Šavnik informed the interested public on February 11 of the current year - that Elektroprivreda Crne Gore AD Nikšić - Directorate for Development and Engineering, as the "project holder" (construction of HPP Komarnica, on the river Komarnica - op.a.), submitted a request to the Environmental Protection Agency of Montenegro (AZŽSCG) "for approval of the Elaboration of the environmental impact assessment for the construction of HPP Komarnica, on the river Komarnica, Municipality of Šavnik and Plužine".
And what am I going to do, run to the address epa.org.me, where I found that the AZŽSCG, referring to Article 20 of the Law on Environmental Impact Assessment (SLCG 75/18, dated November 23, 2018), on February 3 2022 informed the interested public about the same matter, and that the Elaborate - 446 pages, with appendices - was duly made available to the public - and that the deadline for the public discussion, which was also the (first) deadline for submitting remarks and opinions in in writing to the address of AZŽSCG - therefore, by March 10, 2022.
On March 11, AZŽSCG informed us that "due to great public interest, the public debate on the Elaboration of the Environmental Impact Assessment for the construction of Komarnica HPP, on the Komarnica River, Municipality of Šavnik and Plužine" is being extended - until March 25 of the current year - which did not prevent 42. Glory and mercy to the Government of Montenegro, that at the 62nd meeting held on March 10 of the current year, after adopting the Information on the implementation of the Komarnica HPP construction project - to pass, as I said, and it is not difficult for me to repeat - the Decision on granting a concession for the use of natural resources..., and accept the proposal for a concession contract.
Aside from the fact that in the Contract Proposal we also have Article 3 (Implementation of the contract) - which is also my favorite article and which says, I will quote: "3.1 The Concessionaire undertakes to undertake actions and fulfill the parameters from the Technical Resolution of the Implementation Plan, which is divided into the following phases:/ 3.1.1 Phase I - the phase of the preparation of technical documentation, including the preparation of project documentation, the preparation of studies on environmental impact assessment and the preparation of other documentation in accordance with regulations, which starts from the date of conclusion of the Agreement, and ends with the date of issuance of the building permit ” etc.
The preparation, he says, of a report on environmental impact assessment...
And we, from here, killed ourselves to list those - how many foreign works did I say? - and to submit remarks and opinions on time to the address of AZŽSCG - and that in writing.
In order to make things a little clearer, it should be mentioned that the Government, in the Conclusions regarding the Information on the implementation of the Komarnica HPP construction project, complete with the Proposal for the Decision and the Proposal for the Contract (item 4), charged the Ministry of Capital Investments "to carry out the negotiation process with Elektroprivreda Crne Gore AD Nikšić, with the aim of harmonizing the final text of the contract proposal", and that "within 60 days from the adoption of these conclusions, submit it to the Government for consideration and acceptance".
Dritanova the minority Government, how we beat it - or the 43rd Government of Montenegro, our mother, glory and mercy to her! - was voted on April 28 in Cetinje equally and no less famous - so that already on May 3 the Prime Minister of Montenegro, Dr. Abazović, accompanied by the Minister of Ecology, Spatial Planning and Urbanism, and at the same time the political director of GP URA, Mrs. Novaković Đurović - visited Potprisoje, in order to talk to the activists who stood up to defend the Komarnica river - on which occasion he stated, among other things, that his Government - unlike the previous one, I would like to emphasize - cannot undertake activities until the "Elaborate for protection of the environment" - i.e. the Environmental Impact Assessment Elaborate.
"Depending on that study, which will be finished at some point," says Dr. Abazović, "we will see how we proceed."
And I, what am I going to do, run again to the address epa.org.me (AZŽSCG), where I found that under the tab Permits and solutions/ Consent to the environmental impact assessment - we consent to the Elaboration of the environmental impact assessment for the construction of HPP Komarnica, on the Komarnica river - with the condition that Dr. Abazović was referring to that study, which is already finished, that's what it says - but, well, it looks like he still hasn't received approval from the competent agency. Unfortunately, I didn't get the request for approval - and I didn't find the report from the public hearing either...
Mrs Novaković Đurović then stated, for her part, that she is also willing to wait for the elaboration - "It's a matter of days", she says - and that it is "a document without which no further step will be taken".
By the way, Mrs. Novaković Đurović appeared in Potprisoj in a light white blazer with beige vertical stripes, a white shirt, white pants (on the line) with a narrow black belt, white leather sneakers and beige socks with a black border - and she acted on the occasion, I can't without noticing, very lofty and classy (as Mr. Bečić, former President of the Assembly would say), but at the same time very natural - as if she went for coffee with her friends.
