The Ministry of Ecology, Spatial Planning and Urbanism is aware of the criminal complaint submitted to the Special State Prosecutor's Office, due to the planned construction of a building on the site of the heliport in "Porto Montenegro", which additionally extends over 200 square meters into the sea, but that so far no changes to the State Study of the location are planned (DSL) "Arsenal" in which that building is drawn.
From this minister's department Ana Novaković Đurović, also stated that the program assignment for the preparation of this study from 2019 stated that the aim of the plan changes is to adapt to the investors' interests and their plans.
"During the development of amendments and additions to DSL Arsenal Tivat, the parameters defined by the higher-order planning document were respected, i.e. spatial plan of special purpose for the coastal area. So far, no changes or additions to DSL "Arsenal-Tivat" are planned, it was stated in the answer.
At the end of July, "Vijesti" published a text about the criminal complaint submitted by a group of citizens against Seljanov Mladena Krekića the executive director of the company "Business Art", as the then manager of the development and responsible planner of DSL Arsenal Tivat, and responsible persons in the then Ministry of Sustainable Development and Tourism due to suspicions that they abused their official position during the preparation and acceptance of changes to this plan in favor of investors and to the detriment of the public interests and interests of the citizens of that settlement.
"In the 2019 Decision and Program task for the preparation of amendments to the State study of the location 'Arsenal - Tivat', it was stated, among other things, that the relevant changes to the plan were aimed at harmonizing planning and development intentions, through a structured redistribution of zoning, space use and gross construction areas. Also, in the program assignment, it is stated that the investment attitudes of the existing owners are based on constant challenges to proactively adapt and improve the success of 'Porto Montenegro' depending on changes in visitor expectations, demographic and visitor profile changes, in the increasingly competitive environment of the Bay of Kotor, thereby creating new tourism and development projects. As hospitality and nautical tourism form the basis of the most fundamental target area of growth in the region, the new investment strategy envisages the ability of Porto Montenegro to be self-functioning and to maintain activity during the off-season with the aim of ultimately being a destination that is active and that provides jobs during the whole year", it was stated in the Ministry's answer to the questions about this criminal report, the disputed plan and whether they plan to conduct an audit of DSL "Arsenal".
The catchment area of this DSL is a total of 168,52 hectares, of which 29,42 hectares are on land and 139,1 hectares are at sea.
"The Ministry has so far issued urban technical conditions (UTU) number 18.11. 2022 and on the basis of them, bearing in mind the urban planning parameters, it cannot be determined whether and to what extent the object in question will be built on the sea," the Ministry stated.
However, in this Ministry document, which was published on their website, it is written that the urban plot on which the building will be built consists "of cadastral plot 965/23 KO Tivat, part of cadastral plot 185/2 KO Tivat and part of the Adriatic Sea".
Morski dobr then told "Vijesta" that the future building enters the Adriatic Sea in an area of 215 square meters, as well as that during the public hearing on the amendment of this DSL, they submitted their remarks, but that their opinion was not sought when issuing the UTU for this building. nor was it mandatory.
The Ministry states that Morsko dobro can initiate the change of the plan, although only the Ministry can do it. However, according to the locals, preparations for the construction of the facility have already begun at the location itself.
"Given that the planning document is located in the zone of the maritime domain and that the area of the land and the water area has been elaborated in the plan, it has been submitted for opinion to the relevant institutions, among others, JP Morsko dobro. According to the Law on Spatial Planning and Construction of Buildings, the procedure for creating a planning document does not include mandatory giving of opinion and consent by JP Morsko dobro. By the way, JP Morsko dobro, in the capacity of a legal entity that manages marine resources, continuously submits initiatives to the Ministry on the need to prepare planning documents that regulate the area of marine resources", it was stated in the answers of the Ministry.
On this location, it is planned to build an object - a condo hotel with a ground floor and five floors, and it would be surrounded by the sea on three sides. In the application, it was stated, among other things, that DSL "Arsenal" after the changes from 2013 and 2019 deviates in several parameters from the norms of the spatial plan of the special purpose area for the coastal area in order to meet the demands of investors.
Earlier questions from "Vijesti" about this case were not answered by the Special Prosecutor's Office, "Porto Montenegro", nor by the designer Krekić.
