DRI: Five state bodies paid out more than two million euros based on the work contract in 2022

The Ministry of Economic Development and Tourism, the Ministry of Agriculture, Forestry and Water Management, the Ministry of Ecology, Spatial Planning and Urbanism, the Revenue and Customs Administration and the Environmental Protection Agency are from 2020 to 2022, on the basis of contracts for the work they engaged natural persons , paid out 4,5 million euros, of which 2022 million euros in 2,09 alone.

This was determined by the State Audit Institution (DRI) in the Report on the audit of success "Successfulness of engaging natural persons without establishing an employment relationship in state bodies".

The SAI assessed that the engagement of natural persons without establishing an employment relationship in state bodies, in the period covered by the audit, was not carried out successfully.

They said that, due to the lack of proper records, there is no information available on the number of engaged natural persons and the total amount of funds spent on that basis at the state level.

"The increase in expenditures based on work contracts with audit subjects, which is accompanied by inadequate planning, non-transparent selection of engaged persons, with the absence of supervision and analysis of the effects of performed work, is inconsistent with the goals of optimizing public administration. The exception is contracts concluded with natural persons after the implementation of the public procurement procedure (expert-consulting services) or public call for candidate applications (advertisements)," the SAI announced.

They said that the lack of internal procedures and proper monitoring of the implementation of the contract indicates that the process of engaging natural persons is not organized in an efficient manner.

"Engagement of natural persons with a work contract (or another type of contract) to perform tasks for which workplaces are systematized, in addition to the fact that it is in contradiction with the Law, additionally complicates the management and optimization of work processes within the body, allows natural persons access to data that are intended civil servants and affects the loss of institutional memory," notes the SAI.

They said that this institution, based on the conducted audit, and with the aim of ensuring the professionalization and depoliticization of public administration and improving the process of hiring natural persons in state bodies, gave nine recommendations to the subjects of the audit.

Audit subjects should, in accordance with the law, submit to the SAI by October 5 of this year an Action Plan for the implementation of recommendations and by March 5 of next year a Report on the actions taken based on the recommendations made and submitted.

In accordance with the protocol on the cooperation between the Assembly and the SAI, the SAI's final report was submitted to the Parliamentary Committee for Health, Labor and Social Welfare and the Committee for Economy, Finance and Budget, as well as to the Ministry of Public Administration.

The final report on the success audit "Successful engagement of natural persons without establishing an employment relationship in state bodies" was adopted, at the session on September 5, by the DRI Collegium composed of: Dr. Branislav Radulović (Head of the Collegium) and Mr. Zoran Jelić (Member of the Collegium).
