Do Kwon can be extradited to the USA and South Korea: Milović decides

After a secret deliberation and vote, the Supreme Court of Montenegro passed a verdict last week approving the request for protection of the legality of the Supreme State Prosecutor's Office. This annuls the earlier decisions of the High Court in Podgorica and the Court of Appeal and returns the case to the High Court in Podgorica, as the court of first instance, for a new decision.

The extra-judicial panel of the High Court in Podgorica, presided over by Judge Boris Savić, issued a decision stating that the conditions for the extradition of crypto-currency king Do Kwon to South Korea and the United States of America (USA) have been met.

Marija Raković, independent advisor for public relations of the High Court, told Vijesti that the final decision on who will be extradited to the king of crypto currencies will be made by the Minister of Justice, Andrej Milović.

However, this decision is not legally binding because there is a right to appeal to the Court of Appeal, the RTCG portal reports.

South Korean citizen Do Kwon has been in a shelter for foreigners in Montenegro since March 23 after serving a four-month prison sentence to which he was sentenced for forging personal documents, after he was arrested at the airport in Podgorica with a fake passport.

Do Kwon and his business partner Chang Jun were arrested on March 23 last year at the Podgorica airport when they tried to travel on a private flight to Dubai with fake passports.

For falsifying passports in Montenegro, they were each sentenced to four months in prison.

According to an earlier announcement by the High Court, Do Kwon is being sued by South Korea for the criminal offense of unfair trading, fraud and breach of public offering.

The United States District Court for the Southern District of New York charges Do Kwon with multiple felonies including conspiracy to commit securities fraud, wire fraud, and securities price manipulation.
