The State Election Commission (SEC) announced that the legal conditions for declaring the final results of the parliamentary elections held on June 11 have not been met, because the deadlines for submitting objections to the SEC and appeals to the Constitutional Court are still pending.

The SEC reminded that the deadline for publishing the final election results expires tonight at midnight.

"Given that the procedures for objections and appeals are still ongoing, i.e. that the deadlines for submitting objections to the SEC and appeals to the Constitutional Court have not yet expired, the legal conditions for determining the final election results and publishing them have not been met", it is stated in the announcement.

The SEC said that from the holding of the elections on June 11, 2023 until today, the Commission received a total of 24 complaints, on which this body acted in a timely manner and within the legal deadline of 24 hours.

"The reasons for the delay were to a certain extent influenced by the fact that those who submitted complaints to the election commissions, that is, complaints to the Constitutional Court, used the last deadline to submit them, using their indisputable legal right," said the SEC.

They explained that the deadlines for submitting objections to the SEC on the decisions of the municipal commissions, that is, appeals to the Constitutional Court on the decisions of the SEC, begin to run from the moment the decision is delivered.

"Since all actions related to the delivery of decisions, conclusions, as well as other acts, files, documents, submissions and the like are accordingly applied to the rules prescribed for delivery in administrative proceedings, the SEC and other competent municipal election commissions were obliged to apply the Law on Administrative procedure, in accordance with which, at the request of the applicants, the decisions were delivered by mail," the announcement says.

The SEC, speaking about the legitimate right of the complainants to demand that the decisions be delivered to them in this way, pointed out that this is another circumstance that this body could not influence, and which will affect the prolongation of the determination and publication of the final results of choice.

"According to the Law, within 12 hours from the expiry of the deadline for submitting objections and appeals, i.e. from the finality or enforceability of the decisions made following objections or appeals, the SEC will hold a session where the final results of the election will be determined, and the public will be informed about this in a timely manner ", the announcement states.

The SEC emphasized that the delay in determining and publishing the final results of the election was not due to a mistake by the election administration, since the State Election Commission decided on every objection within 24 hours.

"Already due to the inconsistency of the provisions of the Law on the Election of Councilors and Members of Parliament, which refer to the deadline for determining and publishing the results of the election, with the deadlines of the Law on Administrative Procedure, which refer to the submission of acts", announced the SEC.
