The final election results may be by the end of July: There is no rush when defending "voters' rights"

The Constitutional Court needs to rule on seven appeals from the Pravda za sve list, and there is a possibility that ten more will be submitted to that institution.

The announcement of the final results of the extraordinary parliamentary elections can hardly be expected before the end of this month or the beginning of August, given that the Constitutional Court has yet to rule on several appeals filed by the former minister's list Vladimir Leposavić.

Before that court are seven appeals filed at the end of last week by the holder of the electoral list "Justice for All" Leposavic, and according to "Vijesti" information, at least a dozen more are likely to be filed.

Yesterday, the Constitutional Court requested a statement from the State Election Commission (SEC) for five appeals, which has 24 hours to provide it with an answer - which is today. When the SEC submits the requested documentation to the Constitutional Court, that institution makes a decision within 48 hours. According to "Vijesti" information, it is possible that the court will sit on that occasion on Friday.

In the meantime, the same procedure and deadlines are repeated for appeals, which are announced and Leposavic confirmed to "Vijesta".

Vladimir Leposavic told "Vijesta" that the deadlines for submitting appeals to the Constitutional Court have not passed because they run from the moment the decisions of the SEC are delivered.

"We have already submitted seven appeals to the Constitutional Court against those decisions that were duly delivered to us. In the following days, the remaining decisions of the SEC must be delivered to us, and we will, within 48 hours, file appeals against any decision with which we are dissatisfied. So, as we promised to the people who put their trust in us", he said.

He said that the appeal procedures would have ended earlier if the SEC had been more efficient in decision-making and more up-to-date in delivering its decisions.

"Or, to be more precise, if the municipal election commissions and SEC had not implemented and amined election irregularities and thefts, there would have been no complaints at all. The problem is on their side. Justice for all! is the solution to the problem", said Leposavic.

Answering the question to explain why the list he led insists on personal delivery of all documents, Leposavic said that the law does not allow any other possibility in such cases.

"The Electoral Law refers to the direct application of the Law on Administrative Procedure, which in Article 84 prescribes the following: "Delivery of a letter must be made personally to the person to whom it is intended, when it is a letter whose delivery begins with a deadline that cannot be extended". I, as an authorized person of the Justice for All! movement, am in the country all the time and I have taken over every properly submitted decision within the short time frame provided for by the current regulations."

Leposavic added that "if someone thought they were delivering via Viber, Facebook and the like, that is not in accordance with the law."

"We insist on the rule of law, as we have said we will do in all situations, including in this one when we are defending the constitutional rights of people who voted for Justice for All," said Leposavic.

President of the State Election Commission (SEC) Nikola Mugoša he said that the Commission considered 14 objections of the electoral list Pravda za sve, which were submitted by the holder of the list Vladimir Leposavić and the candidate for deputy Ivan Vukicevic.

"All objections were submitted to the official e-mail address of the Commission or directly to the archive. In all objections to this electoral list, it was pointed out that the applicant demands that, in accordance with the Law on Administrative Procedure, decisions on objections be delivered to him by mail, which was done," said Mugoša.

He emphasized that the Commission decided on all objections within the legal deadline of 24 hours, and that there was no delay in any situation.

"Also, the SEC sent a letter to the Post Office of Montenegro requesting information on the status of the delivery of the decisions submitted to the aforementioned electoral list, that is, on the date and time of delivery," said Mugoša.

The Constitutional Court has so far accepted the SDP's appeal against the decision of the State Election Commission and ordered the Cetinje Election Commission to repeat the voting at the polling station Lovcen Partisan Division II. The court previously rejected three SDP appeals, as well as the appeal it filed, as unfounded Bozidar Vujicic from Budva.

Voting at one polling station in Cetinje will be repeated on July 8.

Based on the election calendar, the SEC planned to announce the final results on June 26, but appeals postponed it.

After the announcement of the results, there will be a constituent session of the Assembly, followed by a month's deadline for the president to give a mandate for the composition of the government.

The incumbent then has three months to form a cabinet based on the results of the June 11 election.

The "Europe Now" movement won 24 mandates, the Zajedno coalition, gathered around the Democratic Party of Socialists, won 21 mandates, the For the Future of Montenegro coalition won 13 mandates, the Democrats and Civic Movement URA coalition won 11 mandates, and the Bosniak Party won six mandates.

The coalition of the Socialist People's Party and Demos will have two parliamentary seats, as well as the Albanian Forum. The Albanian Alliance and the Croatian Civic Initiative each received one.

The SDP, which lacks about 300 votes to have two mandates, remained without parliamentary status.

"Private for all", Movement for Changes, Movement for Upheaval, People's Coalition "Složno i dočka" and the list "Mi momoje" are also under the census.

Leposavić: The SEC implements the obstruction, we use our constitutional rights

Answering whether his actions indicate deliberate obstruction, Leposavic said that the journalist's question indicates discrimination, because, as he claims, such a question was not asked "to other political subjects who use the same constitutional rights these days or have done so before."

"It is well known to the public that all the media in Montenegro have their wards on the political scene, as we are at Pravda za sve! consciously chose to be that political entity that has no tutors among media houses. However, this is no justification for abandoning the basic requirements of objective journalism. You practically accused me with this question, although you admitted in your first question that you do not know whether the legal deadlines for exercising constitutional rights have passed."

He said that the People's Movement Justice for All! does not obstruct or intend to do so.

"The obstruction is carried out by the SEC, which in its previous decisions has stated in response to our objections that it did not conduct evidence, i.e. inspected the disputed election material, because, as they reasoned, it would require too much effort for them. Such decisions have been overturned by the European Court of Human Rights more than once. This is obstruction, as well as what is being done in the election process in Šavnik. We at Pravda za sve! we exercise our constitutional rights and we will continue to do so in front of domestic and international institutions in all subsequent processes - until justice for our voters is served", said Leposavic.

Vujović: The US makes party-colored decisions

Secretary General of SDP Ivan Vujović he said that a particular disappointment is the Constitutional Court "which, in purely legal situations that are clear even to the most laymen of the law, makes party-colored, and not legal and constitutional, decisions".

He said that they showed the public evidence of numerous malpractices in the election process to the detriment of that party.

"A huge number of ballots deliberately made invalid in order to erase votes for the SDP. Only on about five percent of the examined material, we found that there are about thirty such cases, which clearly shows how damaged the SDP is. The behavior of election commissions, which, with the exception of professionals with integrity, act in accordance with the needs of the party, and not the letter of the law, is an indicator of the complete collapse of institutions," Vujović said. He pointed out that there is no doubt that there will be a mass vote for their list at the LPO8 polling station on July 2, because the citizens of Cetinje are aware of what the SDP means in Parliament when it comes to protecting state interests.
